  • OR: Supreme Court Rules Police may not ask if a Person is Armed, without specific cause

    Gun Watch ^ | 11 July, 2015 | Dean Weingarten
The Oregon Supreme Court has ruled that generic "Officer Safety" is not sufficient to ask people if they are armed.  In a ruling on July 9th, 2015, the court found that police officers may not simply ask someone if they have a weapon, if there is no good, specific reason.  From State v. Jimenez(pdf): In this criminal case, an Oregon state trooperstopped defendant for jaywalking and asked him if he hadany weapons on him. For the reasons that follow, we concludethat Article I, section 9, of the Oregon Constitution1 does notpermit a law enforcement officer to make such an...

Breitbart News sat down with Rep. Thomas Massie (R-KY)91% (R-KY-4th Dist.) earlier this week, and he explained that he put forth a rider to a Department of Justice appropriations bill to block the ATF “from banning common rifle ammunition” out of concern that “Obama’s swan song is gun control by executive order.” On June 3, Breitbart News had reported that GOP representatives were adding riders to the bill to deny funding and block the DOJ and ATF from following through on backdoor gun controls under consideration at the time. Massie now explains:

Oregon is one of the states that has stubbornly refused to grant reciprocity to concealed carry permits from other states, even though many of those states recognize the Oregon permit when Oregon residents visit them.  The map above, from usacarry.com, show that Oregon does not recognize  a single other state. The map below shows that 20 states allow Oregon residents to carry in their state, with an Oregon permit.  Vermont does not require a permit.  The blue states recognize the Oregon permit.  Michigan only recognizes Oregon permits for Oregon residents. Oregon is one of the most restrictive states for carry permit reciprocity.   It does not recognize any permits from any other state.  There are eight other states that are as restrictive.  They are Hawaii, California, Maryland, New Jersey, New York, Connecticut, Rhode Island, and Massachusetts.    Most are the last hangers on to the old "may issue" permit system, where the right to carry is not just subject to fees, classes, background checks, and waiting for government permission, but is subject to some, often unelected,  bureaucrat's feelings and attitudes toward you and your lifestyle.   Rhode Island is the...

“This investigation highlights something we’ve known for a long time – that the online market for guns leaves a gaping loophole for criminals and other dangerous people to buy a gun without a background check,” said Sarah Finger McDonald, one of 50,000 Oregon members of the group Moms Demand Action. According to Everytown’s research, gun sales online eclipsed sales at gun shows by a factor of four. More guns were sold by unlicensed vendors online in a week than at a year of Oregon gun shows.

On March 27 215 Gabby Giffords backed Oregon Democrats in pushing all future Oregon gun purchasers to pass the same background check Jared Loughner passed to acquire the firearm with which he attacked Giffords and eighteen others in Tucson. The legislation–SB 941, sponsored by [longtime gun banner] state senator Floyd Prozanski (D-Eugene)–would require a background check for every gun sale and/or transfer in Oregon–whether retail or private–except for sales between “close relatives,” which would continue to be a privilege the government allows.

It probably won’t be cheap and it certainly won’t be private. Here’s an email blast we received from the Oregon Firearms Federation:

Oregon lawmakers are gearing up for another round of debate over firearm regulations. Democrats introduced a measure Thursday that would require criminal background checks for most private gun sales. If the proposal sounds familiar, it's because similar measures were introduced and failed in the last two legislative sessions. The difference now? For those of you in Oregon, this is of special importance for you. Anti-gun extremists brag about how many people are denied gun purchases under the current system but never talk about how many of those people are denied with no justification because of an inept bureaucracy. The State Police’s own figures show that almost all “denials” are unjustified. Amazing but true. Details: There aren’t a whole lot of priests in the Latin Church with two grown sons, but the Archdiocese of Seattle’s newest priest, Father Mark Kiszelewski, is one of those few. He was ordained to the priesthood June 8 by Archbishop J. Peter Sartain at St. James Cathedral. From an early age, Father Kiszelewski, now 58, felt a tug toward the priesthood, but his path to ordination was obviously not a direct one. From seminary to ‘real world’Growing up in Merrick, N.Y., he admired the priests at Cure of Ars Parish, where he also attended the parish school.“I oftentimes...

Democrat Ginny Burdick -- the most impassioned gun-control advocate in the Oregon Senate -- recently dealt with one of those home visits. Some klutz spent several hours filming Burdick outside her home, and Jeff Reynolds, chairman of the Multnomah County Republican Party, gleefully posted the video online. ---------------------------cut------------------- Burdick, meanwhile, has announced that four gun-control bills -- including background checks on all gun transactions except those between immediate family members -- will be heard Thursday in Senate Judiciary. "It's clear that intimidation works," Burdick said. "This is the extremist, highly motivated fringe. The strategy is to make life so miserable...
