The charges brought against George Zimmerman sure look like prosecutorial misconduct. The case as put forward by the prosecutor in the “affidavit of probable cause” is startlingly weak. As a former chief economist at the U.S. Sentencing Commission, I have read a number of such affidavits, and cannot recall one lacking so much relevant information. The prosecutor has most likely deliberately overcharged, hoping to intimidate Zimmerman into agreeing to a plea bargain. If this case goes to trial, Zimmerman will almost definitely be found “not guilty” on the charge of second-degree murder. The prosecutor wasn’t required to go to the...

The Trayvon family is not seeking justice in the form you would think. No, they are seeking monetary justice, or more directly monetary gain. THAT is the motivation; and the absence of an “arrest” is what stood between them and their ability to sue in civil court”. Ask yourself why would anyone want an arrest without a conviction? “We are not asking that he be convicted; We are asking that he be arrested” Why is that so important? The answer can be found in the statutes of Florida law surrounding Justifiable Use Of Force (Statute 776) which outlines in Statute...
  • George Zimmerman court affidavit: 'Zimmerman confronted Martin'

George Zimmerman, the Neighborhood Watch volunteer arrested yesterday in the fatal shooting of 17-year-old Trayvon Martin, faced a judge for the first time this afternoon. Meanwhile, a probable cause affidavit has been filed in the second-degree murder case. In the two-page document, prosecutors offer little new information about the shooting. However, they said in the affidavit that "Zimmerman confronted Martin," an apparent contradiction of Zimmerman's version of the events that led to the shooting. The document says Trayvon's mother identified the screams for help heard in a 911 call as those of her son. It also reveals that investigators interviewed...

Just in case tensions weren't high enough in the Trayvon Martin case, the head of a controversial Hispanic group appears happy to pour gasoline on the fire. Calling for an African-American-Hispanic alliance against "common enemies", La Raza President Janet Murguia used Wednesday's Al Sharpton radio show to spread an incendiary message of hate. Happy to conveniently overlook George Zimmerman's Peruvian ancestry, Murguia made her divisive agenda abundantly clear.

Heavyweight boxing icon Mike Tyson thinks it's disgraceful that George Zimmerman "hasn't been shot yet" or "dragged out of his house and tied to a car and taken away."  In other words, the U.S. justice system, and in turn, the U.S. Constitution, is a disgrace. Tyson made his assertion during an interview with Yahoo News.  Asked for his view on the Trayvon Martin case, he averred: “I wasn’t there, I don’t know what happened. But it’s just so widespread and overt what happened.” He just countered his own assertion.  He wasn't there, he doesn't know what happened.  But because it's "widespread" --...

Link to Miami Herald news article Cheney Mason, the freewheeling criminal defense attorney who successfully defended tot mom Casey Anthony, is shaking his head over the second-degree murder charge against George Zimmerman in the shooting of Trayvon Martin. The charge leveled by prosecutor Angela Corey is too severe and reeks of political calculus, Mason said. “It’s political prostitution,” Mason said. “Now I don’t have all the facts – no one does – but you look at what we know of the case and it looks like the prosecutor bowed to other pressures. “The fact is there is lots of racial...

"COUNT I: IN THE COUNTY OF SEMINOLE, STATE OF FLORIDA, on February 26, 2012, GEORGE ZIMMERMAN, did unlawfully and by an act imminently dangerous to another, and evincing a depraved mind regardless of human life, although without any premeditated design to effect the death of any particular individual, kill TRA YVON MARTIN, a human being under the age of eighteen, by shooting the said victim, and during the commission of the aforementioned Second...

Editor's note: Alan Dershowitz is the Felix Frankfurter professor of law at Harvard Law School. (CNN) -- On the basis of the evidence currently in the public record, one likely outcome of the case against George Zimmerman is a mixed one: There may be sufficient evidence for a reasonable prosecutor to indict him for manslaughter, but there may also be doubt sufficient for a reasonable jury to acquit him. Any such predictions should be accepted with an abundance of caution, however, because the evidence known to the special prosecutor, but not to the public, may paint a different picture. It...
