Attorney General Ken Paxton Secures Temporary Restraining Order Against Biden Administration, Stopping Unlawful ATF Rule from Taking Effect
Office of Texas Attorney General ^

Texas Attorney General Ken Paxton has secured a temporary restraining order from a federal judge that prevents an unlawful rule promulgated by the Bureau of Alcohol, Tobacco, Firearms, and Explosives (“ATF”) from taking effect while the case is litigated.

On May 1, Attorney General Paxton led a coalition suing the ATF to prevent a new regulatory restriction that unlawfully attempted to abridge Americans’ constitutional right to privately buy and sell firearms. The Final Rule was arbitrary and capricious and flagrantly violated the Second Amendment. Despite Congress having recognized the legality of private firearms sales by non-dealers, the Biden Administration issued a new regulation that would subject hundreds of thousands of law-abiding gun owners to presumptions of criminal guilt for engaging in constitutionally protected activities.

A federal district court has halted the implementation of the ATF rule until June 2, 2024, so that hearings may be held.

Another reason why the Bushie wing (Phelan et al) of the Texas GOP tried the shampeachment of Paxton. They would be ok with the ATF 'rule'.

My take: 'we', as in people of the United States, should not have to be fighting our own government to secure our rights.
But then wiser men than I knew the nature of man:

Guard with jealous attention the public liberty. Suspect every one who approaches that jewel. Unfortunately, nothing will preserve it but downright force: Whenever you give up that force, you are inevitably ruined.--Patrick Henry

“Bushie wing”

I must agree, Bush II was the deepest Deep Stater and the RINOest RINO of all posing as Republicans.

I was mislead by the Republican brand and voted for this monster as well as McShame and Romney.

Wow, and I thought only Leftists could successfully get a restraining order to stop a law/ruling from taking effect while there is litigation on it.

Those Bushes fooled me too and it ticks me off to no end. He didn’t fool my younger sister, who passed away a few years ago, and I was furious with her for calling him “Bushie.” I never got to apologize for being so upset with her. Put me in the Never-Bush camp. Forever.

You can't really beat yourself up about that. There has been a lot of things that have come to light that we were kept in the dark about.
However, we can make it right knowing what we know now. Unfortunately, it is going to take time and effort to rectify things.

The Biden administration will almost certainly appeal this district court decision to the Court of Appeals for the Fifth Circuit.

You’re right. I’m a LOT more suspicious about Republicans in general now. I know all about Democrats as their masks are off. But Republicans, Lindsey Graham and the like are the subversives.

There is NO WAY the ATF should be allowed to make such a rule without Congressional oversight. Those Federal employees are GODLESS and in direct violation of the constitution. How is one supposed to sell a firearms collection carefully accumulated over a lifetime with that rule? Huh?

Dubya was a oil man. Even if that was the only issue he was good on, that's good enough for me to vote for him over Gore and Kerry.

In fact, I'll vote for Dubya again, if I'm given the same choice (or Bush vs Obama/Biden).
