Supreme Court takes up Trump immunity appeal

The Supreme Court on Wednesday agreed to decide whether former President Donald Trump can be tried on criminal charges that he conspired to overturn the results of the 2020 election. In a one-page unsigned order, the justices ordered a federal appeals court to continue to keep on hold its ruling rejecting Trump’s claims of immunity from prosecution, and they fast-tracked the case for oral argument in late April.

Trump was indicted in Aug. 2023 on four counts arising from Special Counsel Jack Smith’s investigation into the Jan. 6, 2021, attacks on the U.S. Capitol.

U.S. District Judge Tanya Chutkan originally set a trial date of Mar. 4, 2024, for Trump’s case. But in early February, she threw that date out and indicated that she would set a new one “if and when” Trump’s immunity claims are resolved.

Chutkan had denied Trump’s motion to dismiss the charges against him on the ground that he is immune from prosecution. Smith came to the Supreme Court in December, asking the justices to review that decision without waiting for the U.S. Court of Appeals for the District of Columbia Circuit to weigh in on Trump’s appeal, but they declined to do so.

If they rule against Trump, would that slo serve to limit “qualified immunity”. Especially since that’s just a made by-product of a judicial ruling.

A very highly esteemed law professor, very popular among the cable news channels …very knowledgeable in the law. Though he did say it’s anybody’s guess which way they’re gonna decide to rule, but him personally after reading the documents the Supreme Court justices are going to have to deal with what’s in the presentation. Truly said he is leaning more towards the SC ruling in favor Smith. I pray not🙏🏻

All that means is no immunity from prosecution not that he’s found guilty. To Me Roberts will weasel word another convoluted decision and punt it back to the lower court

The real key is the ruling on his not being on ballot as I think us Trump supporters will vote for him regardless of any court rulings

If our founders wanted a pres to have immunity, they would have put it in the Constitution. They didn't, they did say a pres could be impeached, and charged for a crime. No immunity's for a pres, regardless of what party they are.

I suspect that scotus will once again 'give' more power to .gov via judicial fiat. That has been the trend for decades, continue giving power to our overlords.

The argument is the impeachment clause is the basis for the immunity argument. Sovereign immunity certainly exists for bettor or worse. Congressmen & Senators have immunity on the floor. The president has to have immunity or else he's subject to the whims of every partisan prosecutor in the union.

For those who attack the idea, there's a remedy specified in the constitution but Trump wasn't impeached & removed and fighting for accurate elections is hardly a threat to democracy, insurrection, etc. John Roberts didn't even preside over the 2nd impeachment. What's that tell you?

J6 was no insurrection. It was a riot and likely an optics trap by the Left.

Keep Trump off the ballot for "insurrection" is something SCOTUS has to shut down if it aims to protect the nation.
