Blood Libel Must be Challenged With Tort Action (Vanity)
TCH | January 9, 2011 | TCH

Dear Patriots,

The Leftist politicos and their media enablers have not wasted a moment in blaming conservatives and TEA Party groups for Saturday's shooting of Congresswoman Gabrielle Giffords — during which 6 Americans, including a 9-year old girl born on September 11, 2001, were murdered, and 11 others wounded. The inflammatory rhetoric and defamation propagated by media outlets MUST be LEGALLY CHALLENGED.

We are not discussing "free speech," but rather acts of slander. We are not discussing "freedom of the press," but rather acts of libel... and blood libel at that.

This is an extremely serious issue. If we choose to ignore the sponsors of this reckless propagation, then the unabated continuation of this "dialogue" poses perhaps insurmountable political problems for all TEA Party organizations and other conservative groups, as well as individuals.

It is time for all TEA Party organizations, and Americans of good will, to unite against this blatantly willful defamation. We must take up a strategic LEGAL OFFENSE. These continuing acts of defamatory "blood libel" must be challenged with TORT ACTION. I strongly advise that every TEA Party group or individual, perceiving itself damaged or endangered by this slanderous media campaign, obtain legal counsel to initiate lawsuits against any media outlet or individual responsible for its propagation.

This reprehensible behavior cannot be allowed to stand unchallenged. It is not sufficient to counter the falsehoods by simple refutation with demonstrable facts. History proves this tact to be fruitless against a determined foe. Worse, timidity in the face of aggression generally emboldens the aggressor to escalate the attack against those target groups and individuals--even to the point of mass murder.

Remember Hitler's carnage against the Jews of Europe: He first demonized them, then he marginalized them, then he exterminated them. Do not think for a moment that there does not exists in America a similarly inclined cabal of demented ideologues--those who now assert that the TEA Party organizations and prominent leaders within the conservative movement are responsible for the events of Saturday, January 8, 2011. Such a cabal would not hesitate to resort to their version of "the final solution" to the "conservative problem," if they first tilled the political soil well enough for their sordid deeds to be acceptable to a deceived public. History does repeat its LESSONS--but only for those who refuse to learn them the first time around.

We freedom-loving Americans must not permit ourselves a false security, relying on the sensibilities of our fellow countrymen to preserve the civil peace we have long enjoyed and perhaps taken for granted. We must not rest on the expected virtues bestowed by the American system of governance. We have proof enough of the socialists disavowal of and contempt for the U.S. Constitution--and worse: For even some of our political class who, after they swear their oath to preserve, protect and defend the precepts of that august document, then make public assertions that the same is no longer viable!

I am certain that in 1930 the great majority of German citizenry never conceived possible all the horrors that befell them after 1938. Had they considered the evil that lurks in the hearts of men, they might have taken action to stop the catastrophe that was theirs to suffer or avoid. Had the German Jews acknowledged their peril in its early stages, they might have stopped it cold, while it still could be arrested. Unfortunately, they chose a path too typical to human nature... They chose to deny the obvious advance of the ominous darkness encircling them. They chose to ignore the propaganda, the lies, the distortions and defamation hurled repeatedly against them. Pray America! Pray we do not make the same terrible error in judgment. We must take all possible legal action against those who pervert the rights of free press and free political speech.

Purposeful acts of libel and slander against innocent American patriots demand an IMMEDIATE and DIRECT LEGAL response... And we had best get to it while the light still shines in America, or we too shall face a time of terrible darkness the likes of which we now scarcely think possible.

I agree. I thought it was slanderous.

Haul them into Congress, get them under oath, ask where the evidence is?

What about a class action? Anyone know if anything like that has ever been done?

You are absolutely right. We are sitting on our laurals from this summer’s tea partys and tea party spirit, and seem to be just waiting for 2012, while the house is on fire now. I don’t believe we have two years to sit down and shut up.

The class action idea is worth looking into, and Palin should stand up and holler law suit herself to lead the way. And Rush should raise some hell. Democrats understand lawyers!

I agree completely. In watching the media lie, slander and distort for over 50 years, this is the worst I have ever seen.

Agreed... it might be hard for people like Palin, Beck and Rush to go after the state run media for these blatant lies, but they should.

I would think that it would be easy to prove 3 of the 4 legal requirements for slander:

  1. The speech must be a lie. The alleged shooter is a leftist. Ample evidence of this.
  2. The speaker must know it is lie. The state run media continues to report the lie that these individuals are involved when not only is there no proof that they are, but it is proven that they are not.
  3. The speech must have caused a loss to the subject of the speech. Not sure how to prove this.
  4. The speech must have been made with malicious intent. Very easy to prove, the state run media hates these people and this is very well documented.

#3 could be proven: There is no doubt Sarah Palin has suffered a loss of personal safety due to the many death threats triggered by the libelous media campaign against her. And she will be stuck paying for additional security for both herself and her children in the near term and for many years to come

Surely the demonstrable monetary loss and loss of personal safety would satisfy a court in a libel case.

Since NY Times v Sullivan in 1964 it’s virtually impossible for public figures to sue for libel in the USA. Get these scum to post their lies on an English website, and then sue them in London!

I would like to help too.

Solutions should be mandatory with every griping post, but I’m not that quick. I wonder about the Jay Seculow outfit. The American Center for Law and Justice for advice on cause (if I even got their title right)? Freepers should be coming along who will know how to push for info and answer this slander.

What about a class action is the question? Tea Party members are individual non-public figures, AND a minority— maybe that will help. /s

Never looked at it from that angle. I am sure Gov. Palin could provide a nice itemized list of how much she has to pay out of her own pocket for security. The same is probably true for Rush, Glenn Beck, and other conservatives who are still being falsely accused of killing people.

“Since NY Times v Sullivan in 1964 it’s virtually impossible for public figures to sue for libel in the USA.”

Save but one issue there... Most members of the various TEA Party groups are private individuals, not public personalities. So if any one of them now suffers any degree of harm, that can be directly attributed to this defamation, then you have a case. For instance, should any member of a TEA Party group now be attacked by an SEIU thug, etc... Bingo. That would include “hate mail,” harassing phone calls, etc.
