The Leahy Rules for Supreme Court Confirmation Mean Gorsuch Must Be Confirmed

In preparation for the Gorsuch hearing next week, we thought we would mention some of the Democrat Rules for confirmation of a Supreme Court Justice from their most senior member. The Leahy Rule (Part 1) on the President’s power to pick a Supreme Court Justice.

And I think as members of the [Judiciary] Committee, we should respect the mandate the president has earned. The president had told us in 1980 and 1984 he would appoint judges of his philosophy. He was given a mandate to do that. This Committee, if the nominees are otherwise qualified, should respect that. This quote is incredibly relevant as President Trump ran on Gorsuch as a possible nominee. Thus, he deserves even more respect than President Reagan on that front.

The Leahy Rule (Part 1) dictates Gorsuch be confirmed as long as he is “otherwise qualified.” The Leahy Rule (Part 2) dictates that the ABA rating of a nominee is the gold standard. As current Judiciary Chairman Chuck Grassley stated recently (emphasis ours):

So what if democrats and liberal republicans promise ahead of time to vote for Gorsuch. What if the vote is started and they don’t?

What if they have the media report a last mminute slur on Gorsuch?

Can he then receive another vote?

The factor not in the equation is that, without fail, the rules are always different for Democrats. Every time, every issue, every situation, every vote.

“The ABA’s ringing endorsement is no surprise given Judge Gorsuch’s sterling credentials and his distinguished decade-long record on the Tenth Circuit,” Senate Judiciary Chairman Chuck Grassley, R-Iowa, said in a statement.

“Former Chairman [Sen. Patrick] Leahy and [Senate] Minority Leader [Chuck] Schumer have called the ABA’s assessment the ‘gold standard’ in evaluating federal judicial nominations. In light of Judge Gorsuch’s impeccable record, it’s hard to imagine any other result from the ABA’s consideration.”

The Leahy Rules mean that Judge Gorsuch should be promptly and easily confirmed.”

Just make the Gorsuch approval using the dhimmicrat recently minted nuclear option. All bets are off with civility.

Mitch McConnell is the key player in this and most upcoming legislation for that matter. He will probably have to enact “The Nuclear Option” in order to get Gorsuch confirmed in the Senate. Same with Phase III of upcoming GOPCare, new tax bill, others. But, sadly, I don’t believe McConnell has the stones to pull the trigger....

I don’t trust Chuck Schumer or any democrat in congress, especially the Senate. I don’t trust republican senators Murkowski, Snowe, Collins, Portman (my own).

When is congress going into recess? I hope the president has everything ready to do the minute the gavel hits for recess to appoint every remaining appointee as a recess appointee. I also hope he has plans to end the judicial tyranny by those black robed America hating judges. Allowing them to exercise power that they do not have will only embolden them to take further action to destroy the country we love. He must demand that congress back him up with legislation, even though it may be difficult since our own republican speaker is a traitor to the party. The president should calk Ryan out publicly and humiliate him until he acts to support us. If I could speak to the president I would tell him not to give up on us, we are not giving up on him, and that this old retired veteran remains ready to do whatever he ask to get the job done to include laying down what is left of my life if necessary.

For the life of me I don’t understand why Republicans don’t play hardball. At least go back to the real filibuster rules. Make those suckers stand in the well of the Senate for as long as they can. No tag teaming, no pee breaks, go until you can’t talk anymore. After that, vote. Forget this 60 vote cloture crap. We should also get rid of the 17th amendment while we are at it. We already have direct representation in the house.

There is no civility when only one side is civil. Mitch and Ryan need to go!

Conservatives are united behind Judge Neil Gorsuch’s nomination to the Supreme Court. But facing potential Democratic obstruction, they’re divided over the best way to get him there.

The question is what to do if Democrats decide to filibuster Gorsuch, a hard-line tactic that would normally require 60 votes to overcome.

The White House, Republican leadership in Congress and outside conservative groups have varying levels of enthusiasm for triggering the so-called “nuclear option” to change Senate rules and muscle Gorsuch through on a simple majority vote.

President Trump has signaled that he’s gung-ho about the maneuver.

“If we end up with that gridlock I would say, ‘If you can, Mitch, go nuclear,’” Trump said in early February. “Because that would be an absolute shame if a man of this quality was put up to that neglect. I would say it’s up to Mitch, but I would say, ‘Go for it.’”
