What Does – Due Process – Mean To Freedom In The United States Of America?

I want to make it clear before I begin this article, I am a woman, a mother of two sons, an admirer of my father, and I am married to a man. Further, if I had ever been sexually assaulted – raped – in my life these are steps I would have taken –

Go straight to the hospital and beg for help – they have rape kits, authorities, and sedatives there – of course, I would have wanted law officers present. If I did not take the first step, I would accept I had made a decision that my attacker would never be brought to justice. If I were young and still living at home, my parents would also have been involved. After the steps above, the authorities would provide due process to my attacker and to me. Of course, if the rape kit had proven positive the authorities would have the DNA of my attacker. This would have been traumatic, and I would have had go into a counseling environment. For most women their first sexual encounter makes a vivid and everlasting impression on them. For it to be forced with brutality would cause that woman to be traumatized for the rest of her life.

If that woman were traumatized and in counseling, she would forever recall every horrible detail repeatedly for the rest of her life.

When one goes into counseling for a traumatic event, one is forced to relive the trauma. It is part of the treatment – I know for I have been in counseling as a trauma patient. It is a difficult step to take, but for most trauma victims it is absolutely necessary for survival.

With Democrats it’s the seriousness of the accusation rather than the evidence against it.

The problem is that the article does not answer the question it asks and does not actually address what due process requires, which is the ability to confront one's accuser, to know the charges against you, and to subpoena witnesses all before a neutral judiciary body including a jury of your peers. It is both substantive and procedural.

What the author does sort of get right is her allusions to the fact that what we are discovering from this is that due process is getting in the way of the left retaking and retaining power (look at the Russia collusion playbook). They[the Communist Democrats - e.g. the neoBolsheviks as we are not learning to describe them] are trying to rewrite the standards of due process to be those of Nazi Germany or Stalinist Russia - your guilt is a political determination - not a judicial one.

This is part and parcel of what our founding father rejected and rebelled against in their bill of indictment against King George III [aka the Declaration of Independence].

the people she claims as witnesses have all denied it. Why is this charade going forward? Read the denials into the record and vote.

Administrative law must be reformed. It’s basically a Star chamber. The bureaucracies make the laws with no real legislative ovesight. They have their own investigators and courts. The judges are incentivized to side with the State. Hearsay evidence is admissible! Incredible. So much law is administrative that everyone can be a target (except government bureaucrats of course)

Sadly, too true.

I’m not saying that we should adopt a standard of turning a blind eye to misdeeds in office by politicians or other civil servants until there has been a conviction, for we should have learned by now that these people protect each other, not just Democrats, when it is to their mutual enrichment. That’s what makes for a deep state to begin with.

But “the seriousness of the charges” — which should go both ways — should involve much more than conflicting claims of two people concerning one event, especially when one claims witnesses that then support the other.

The corruption of the Clintons is a good example:

Bill Clinton was unlike Gary Hart, who was caught changing “his mind about offshore drilling”, in that his actions involved many more women and he was different from Kavanaugh in that his flings were current, even the accused rapes (the witnesses backed them up too) ... BUT it wasn’t about the sex.

You see, the influential journalist who decided to protect Clinton in ‘92 to prevent a rerun of Gary Hart’s fall and a second Bush term, must have soon discovered that Clinton’s muck went far deeper than being a cad and bounder (or Hillary than just being a money grubbing shrew) but they were already committed. And once they helped a Democrat win they soon had many more journalist onboard with them. To listen to the Left it was all about sex because they have trusted the media that buried everything else, at least to the satisfaction of the Clinton loyalists.

The standard being offered by the Democrats is not about patterns of corruption in office but is about trumped up assertions, even entirely absent allegations of additional misdeeds, that fall apart the closer you look at them. As with the “serious charges” involving the elder Bush, the effort is all about the accusers simply being accepted, something the Democrats would never accept when a Democrat is charged, especially spuriously.

But we are to just roll over or we’re bad people.

Well, guess what? They think we’re bad people already. They always will. It’s kinda one of their first principals (blast from the past: how modern liberals think by Evan Sayet: https://youtube.com/watch?v=eaE98w1KZ-c ) This is why it’s so pointless to seek their approval as do many Republicans in office do.

Why are articles discussing rape? Blasey Ford isn’t claiming rape. This escalates a groping session into something it isn’t and playing right into the Dems play book.

Why are you calling it a "groping session"? There is no evidence that Judge Kavanaugh groped her or was even at the supposed gathering where she claims this happened.

I didn't say that he did. Her claim was a groping session wich has morphed into something more by the press.

You haven't addressed my original query in your rush to nitpick.

HER claim was simply groping. That claim has morphed. I was addressing nothing else.
