Florida Democrats on defense amid election fraud investigation (altered state documents)

After saying earlier in the week that the state officials were trying “divert attention” away from the Department of State, which is part of Gov. Rick Scott’s administration, the Democrats on Friday took a different approach: They lawyered up.

“Upon receiving notice of the allegations that the form was incorrect, FDP took immediate steps, including hiring an independent investigator to review the issues at hand,” attorney Mark Herron said in a statement provided by a party spokeswoman. “As soon as we know the results of the investigation we will advise you.”

Under state law governing “fraudulent practices,” it’s a third-degree felony to “knowingly and willfully ... make or use any false document, knowing the same to contain any false, fictitious, or fraudulent statement or entry” connected to the Department of State. While the fraud statute is not contained in the state’s election code, it relates to the 2018 election because the affidavit in question concerned the elections division, which falls under the Department of State.

Why are they only referring this to federal prosecutors, when state law has been broken? shouldn't state prosecutors take this up also?

I wonder if the hoisted by their own incompetence in copying a form in thier system from last election. That form would have been correct in using a November 8 date.

The Florida legislature and Governor Desantis need to spend all of 2019 making sure they pass legislation to FIX THESE PROBLEMS ONCE AND FOR ALL. There is no excuse for this after the 2000 debacle.

Require each county to recount this years ballots or some made up sample ballots 60 days before the 2020 election to make sure they know and acknowledge the procedures to be used.

That is an interesting question. Maybe because there were federal office on the ballot, although it still would make more sense to me to have state prosecutors working it.

My cynical side says they did it so they could say they took action without actually requiring anyone to do anything. Feds won’t do anything because it’s a state law and the state won’t do anything because it was referred to the feds.

I simply cannot believe that, in the midst of an American economic and geopolitical renaissance, the majority of Americans voted last week to put an angry leftist mob back in charge.

Good article on this topic at American Thinker today. See Democrat Corruption is a Clear and Present Danger to America by Patricia McCarthy. Here are her two concluding paragraphs:

How and why the American left has devolved into the kind of party one finds in a banana republic is a mystery. That our media is so anxious to promote their corrupt candidates and the low-brow tactics they employ is a tragedy. Do they do it because they can no longer win by promulgating their Orwellian vision of a socialist state, mandated equality of outcome? Perhaps. They will never sell socialism to enough sentient Americans to win. They need millions of uninformed voters to succeed.

We must not let them cheat their way to power over the rest of us. Their ongoing vote fraud must be stopped and the Democrats need to take a look at themselves and at what they have become. It's not a pretty picture. What they have become threatens to destroy the greatest nation on the planet and they are doing it on purpose. They have nothing but contempt for the US as founded and for those of us who love this country.

No, the form doesn’t contain a date. It refers to 5 p.m. the day before the election.

Under Florida state law governing “fraudulent practices,” it’s a third-degree felony to “knowingly and willfully ... make or use any false document, knowing the same to contain any false, fictitious, or fraudulent statement or entry” connected to the Department of State. While the fraud statute is not contained in the state’s election code, it relates to the 2018 election because the affidavit in question concerned the elections division, which falls under the Department of State.

It is entirely possible that Florida's voting practices may violate federal laws that might include, but are not limited to:

<><> Title 18 U.S.C. §1341, Mail Fraud, 18 U.S.C.§1001, Presenting a False Document to an Agent of the US Government for funding (may involve several felonies and could include forgery);

<><> 18 U.S.C.§1027 False statements and concealment of facts in relation to documents required by ERISA enacted 1974 and other possible offenses including civil and/or criminal RICO violations.

<><> 18 U.S.C. §§1961-68 (RICO Act)18 U.S.C. §1001 (making false Statements to Agents of the US Government,

<><> 18 U.S.C. §241(Conspiracies Against Civil Rights). Violation of Civil Rights under Color of law and conspiracy. Conspiring with others to violate 4th amendment rights.

<><> Possibly full investigations centering on RICO conspiracies under 18 U.S.C. §1962(c) could be warranted because (1) the persons (2) were employed by or associated with a public enterprise (3) that engaged in or affected interstate commerce and that (4) the persons operated or managed the enterprise (5) through a “pattern” (6) of racketeering activity, and (7) the taxpayers were injured by reason of the “pattern” of racketeering activity.

<><> Alleged Offenses could include Violation of Rights – which prohibits in relevant part, “two or more persons (from conspiring) to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District

<><> Title 18 U.S.C. §2 41 – Conspiracy Against Constitutional mandates in the free exercise or enjoyment of any right or privilege secured by the Constitution or laws of the United States, or because of having so exercised the same . . .” See, 18 U.S.C. §241.

Voters should demand the following agencies commence investigations at once:
<><> FBI — Wire Fraud Division
<><> IRS-Fraud Unit
<><> Department of Justice’s Office of the Inspector General,
<><> Department of Commerce’s Office of Inspector General.
<><> DOJ’s Criminal Division— Public Integrity Section
<><> DOJ Criminal Division—Organized Crime and Gang Section.

Keep in mind...falsifying official documents is the preferred criminal method to cover-up larger crimes.

REFERENCE--Falsifying Government Documents. involves altering, changing, or modifying a document for the purpose of deception.......can also involve forgery and/or passing copies of false documents. Falsifying documents is usually done in connection with broader criminal aims, such as extortion, government fraud, tax evasion, money laundering, financing terrorism........

Types of documents commonly falsified may include:
◾Tax returns and income statements
◾Personal checks
◾Bank account records
◾Business record keeping books
◾Immigration documents (such as visas, passports, etc.)
◾Identification cards and birth certificates

Many different types of acts can be considered as falsifying a document, including:
◾Altering or misrepresenting factual information such as prices or monetary amounts
◾Stating false information when requested to provide truthful statements
◾Forging a signature
◾Using official letterheads without authorization
◾Concealing assets or property WRT obtaining federal/state grants))
◾Knowingly using or distributing a fake document

A person can only be held criminally liable if they are deliberately acting with the intention of deceiving or defrauding another party.

Falsifying documents is a very serious offense and is generally classified as a felony. This means that a person charged with falsifying documents may be subject to the following legal penalties:
◾Having to pay a monetary fine
◾Incarceration in a prison facility

Depending on the gravity of the offense, as well as individual state laws, falsifying documents can result in a prison sentence of 5-10 years. Also, if government documents or authorities were involved, the legal penalties may be more severe. ..... legal penalties may increase with repeat offenses.

The penalty for falsifying government documents is outlined in the Crimes Act of 1958.
