Million Plus NJ Gun Owners Defy State Law, Refuse to Turn Over Banned Gun Mags

Over one million New Jersey Gun owners defy Governor Murphy's gun magazine ban & turn in demands of what some estimate is easily more than ten million now illegal standard capacity gun mags.

New Jersey –-(Ammoland.com)- New Jersey's standard capacity magazine ban is now in effect making New Jersey's one million gun owners criminals in the eyes of the state. But in an act of mass definace, New Jersey residents refuse to comply.

Any magazine holding more than ten rounds is now illegal in the Garden State. The standard magazine for an AR-15 holds 30 rounds. Glock 19s, which is the most popular pistol in the United States, holds 15 rounds. Anyone who is possession of larger magazine is committing a fourth-degree felony.

Anyone caught with one of the now banned magazines in their possession faces up to 18 months in prison and up to $10,000 in fines or both for each magazine found.

The bill was signed into law last June by Gov. Phil Murphy (D). Residents had until December 11th, 2018, to turn over magazines to police or sell or store them out of state.

Pro-gun groups sued New Jersey to try to prevent the law from going into effect. Their attempt on blocking the law failed in a federal appeals court. The three-judge panel ruled that a law limiting the number of rounds a magazine holds did not violate the US Constitution and did not put an undue burden on New Jersey gun owners.

“New Jersey’s law reasonably fits the State’s interest in public safety and does not unconstitutionally burden the Second Amendment’s right to self-defense in the home,” the court wrote in their decision.

This is an Opinion piece in the sense that no governing authority, (NJ Attorney General or NJ State Police) has released the number of the banned magazines turned-in.

The article's author has requested through a FOIA to obtain these numbers.

Are we seeing mass Civil Disobedience?

I certainly hope so.

This is wonderful news. And I would expect no less from patriots. The question is ... when do we start watering the tree of Liberty with those who would chop it down? For as long as these attacks on liberty go unpunished, they will continue.

So, how soon until someone is arrested? Make it a police officer and their personal gun as first person. Then let’s see it go through the courts.

I don't know but here's another thought. All indoor and outdoor ranges could possibly face legal consequences if they allow their customers to use the high capacity mags while on their premises..........

They'll probably put up signs prohibiting their use.......

Pro-gun groups sued New Jersey to try to prevent the law from going into effect. Their attempt on blocking the law failed in a federal appeals court.

OTOH, if NJ had passed a law allowing 10+ rounds of ammo, and a liberal group sued to stop it, a stay would have been implemented to stop the law from taking effect until it could be decided by SCOTUS (many years later).

Interesting how the libs can do this but we can't...

On the police theme, in a court questioning the credibility of an officer... "Do you own a personal gun? yes. Do you have any magazines for said gun or guns that hold more than 10 rounds? ???.

My point is that no one, not even the police, will abide by the law. Don't know if New Jersey did same as California and except government employees from the laws they imposed on citizens, but this should be the tipping point in challenging the law.

I compete in IDPA and USPSA matches, wonder if these are now canceled in New Jersey?

I think they deliberately avoided using the word "infringe", but that's just me...

[[Are we seeing mass Civil Disobedience?]]

Yes you are, and now all these people are felons who will never be allowed to own a gun again if the police ever pull them over for anything and find the banned gun mags- and this will happen- case by case- quietly, so that the state doesn’t cause an mass uproar- individuals will be deemed felons, stripped of their second amendment rights, and will be imprisoned- just like they are in NY and other states where certain guns or mags or ammo limits are banned-

The states are not about mass confiscation- they are about individual confiscation and criminalization. The states know they can’t enforce their laws on a mass confiscation scale, because the people would band together and resist- so they do it quietly, case by case-

[[So, how soon until someone is arrested?]]

It’s already being done in many states- and along with the new ‘red flag laws’, many people are being arrested and listed as felons, and there’s only 1 case I’m aware of where a michigan man I believe it was, resisted arrest and was shot to death- The people didn’t mass resist- and soon forgot about that case- which is exactly what the states are counting on- quiet confiscation that doesn’t arouse mass protests-

NY’s ‘safe act’ was brought, but SC refused to hear it i believe- if i remember right they said it was a state issue-

Except a bobble head on NJ TV holding up said magazine like Dave Gregory did in DC where they’re banned. They’re exempt.
