Supreme Court Gun Control Challenge Will Get Its Day In Court

The U.S. Supreme Court on Monday rebuffed continued efforts by New York officials to hold off on a challenge to the City’s restrictive gun laws.

New York had asked the nation’s high court to turn away the case brought by three local gun owners who argue the City’s “premises permit” scheme — which drastically restricts the ability to leave one’s premises with a firearm — is unconstitutional. City officials, once the court agreed earlier this year to review the challenge, changed the local law rather than risk the court ruling that could be applied to other potentially unconstitutional gun control schemes nationwide. This, New York argued, made the case moot.

This week the Supreme Court issued orders that the case will proceed.

“The Respondents’ Suggestion of Mootness is denied,” read the orders of the court. “The question of mootness will be subject to further consideration at oral argument, and the parties should be prepared to discuss it.”

While the law was previously upheld by lower and appellate courts, the Supreme Court agreed in January to hear a further challenge to the City’s restriction — the first such move by the court on a major gun case since 2010. This triggered repeated attempts by the City to short circuit the case, all of which have been turned away.

This is a major move. The SCOTUS would not have denied the claim of mootness if there was not a majority f justices who want to rule on the issue at hand. There are no guarantees of course, but this is an extremely optimistic signal for gun rights.

Excellent! Now to strike down their unconstitutional infringements on Americans’ 2nd Amendment rights. Get it on the books so as to obliterate all similar infringements in the communist states.

Very unlikely to affect local, state or federal legislators or regulators. They knowingly and regularly ignore the Constitution, knowing the legal expense of challenging their transgressions will deter most citizen challenges.

Unless things have recently changed, the entire state of NewYork has 2 types of pistol permits. Carry concealed or premises.
Many jurisdictions add restrictions limiting when you can carry, such as hunting and target shooting only. There is no provision in the law for this, but it has been upheld in NYS courts. Governor Fredo has been doing everything he can to further restrict and harass NY gun owners.

Prediction (sucker’s bet): SCOTUS will pass a camel through the eye of a needle & split hairs as to not rule on 4 words: “...shall NOT be infringed.”

They knowingly and regularly ignore the Constitution, knowing the legal expense of challenging their transgressions will deter most citizen challenges.

Then there need to start being financial penalties for having passed an unconstitutional law, with personal liability for the legislators who enact and execs who sign. Only problem, is it would only ever be enforced against conservatives who violated liberal wet dreams of what they WISHED the Constitution said.

Uh oh....

This means we need Roberts to join the conservatives. This terrifies me. Really, we need to wait until Bader-Ginsberg is replaced before SCOTUS takes these 2A cases so Roberts is irrelevant. He can even join the majority since he would be the 6th and undeciding vote.

NYC knew they would lose as per Heller and Deblabla chose to try to make the case moot rather than risk an expansion of a constitutional right.

In those few states of the radical left, their are too many foreign minds in leadership positions. Their work is antithetical to American culture. Those states and leaders need to be brought back into obedience under the law and customs of our country.
