It is illegal to congregate in public with two or more people while they’re wearing masks or using anything to cover their face and disguise their identity. The law, which has existed since 1845, is outlined in New York Penal Law 240.35(4). However, exceptions are made for instances such as Halloween and masquerades.

The spread of the coronavirus throughout the nation is turning some old laws into new ridiculousness. One of the hardest-hit areas in the US is New York, which has nearly 30% of the nation’s total cases. This has led to lockdown orders and spread deterrent efforts more severe than seen elsewhere in the country.

One of the new mandates handed down by Governor Andrew Cuomo is a mask requirement when in public.

Effective at 8 p.m. on Friday, April 17, 2020 any individual who is over age two and able to medically tolerate a face-covering shall be required to cover their nose and mouth with a mask or cloth face-covering when in a public place and unable to maintain, or when not maintaining, social distance.

Sounds good and necessary, but as appellate public defender Sam Feldman points out on Twitter, this executive order conflicts with a law that’s been around since the middle of the 19th century. Liberals in New York didn’t mind that their laws are being broken, they even attacked other New Yorkers for not wearing a mask.

In Staten Island, New York someone came to a grocery store without a mask. They were shamed by other patrons and driven out.

History repeats because human nature doesn’t change.

This is why we choose option C and that is the Bill of Rights. The 2A protects us from those who can’t seem to read the 1A (which should be damn easy to understand) and try to take our Freedoms away.

I’ve always said that if state legislatures want to get together and pass some sort of legislation aimed at COVID-19, they can do that. Between the 10th Amendment reserving a lot of control to the states, and the State constitutions themselves, state legislatures can do a lot.

But we have straight tyranny when a governor, by himself, decides he can make up laws on a whim. Even more so when his whims violate existing laws that were actually passed, in the proper way, by the state legislature.

That’s really not how it’s supposed to go.

I assume you have no problem with businesses themselves decide to require masks (as in “no shirt, no shoes, no service”) where no government mandate is involved?

Like it or not -=- and I don’t — the state legislature has given the governor of NY broad authority to suspend and modify state law, during an emergency, for up to 30 days at a time, with unlimited renewals, unless overridden by the the state legislature. Sadly King Cuomo (or is he the jester?) has the legal right to suspend the 1845 “mask law.”

I stopped wearing a mask. I am no longer participating in the charade. I was in a 2 stores yesterday where some of the employees were not wearing masks. A lot that where wearing them had their hoses or even mouths exposed.

I do. A business cannot mandate things that violate the ADA. They cannot use no shirt, no shoes, no service to deny someone with a medical device. Likewise they cannot force every customer to use a medical device that may harm them. Massive reuse of single use masks spreads disease, reduces oxygen uptake by 60% (no small thing to asthmatics, elderly, COPD, etc)
They are violating the ADA.

Well, a majority of the anti-mask laws around the country have already been struck down, as they violate the 1st Amendment. New York’s law is kind of a relic, it survived a court challenge a while back, but if they ever really enforced it and it got challenged again, the prospects are pretty good it would be struck down.

I would tend to consider that a bit of a reach legally, the invoking of the ADA. Might work, but I wouldn’t count on it.
