Batavia (NY) Woman Charged With Adultery (says she cheated because hubby's a transgender)

A Batavia woman has been charged with adultery; she and a man are also facing a public lewdness charge. Batavia Police said it stems from an incident last Friday when witnesses called police to say the couple was having sex on a picnic table in Farrall Park around 5:15 p.m. Friday evening. Witnesses and police say children and parents were nearby.

"I think it’s disgusting I mean that's totally wrong,” Danny Bastedo said of the incident that occurred just a few hundred feet from his back door. “I mean 5 o'clock in the afternoon, come on? That's crazy."

"We don't need this in Batavia," Dave Barton said. "I walk the dogs everyday through this park and they're so many kids come in and out of here. Family members playing tennis, kids on the swing sets, these young kids in this community don't need to see it."

The woman involved is charged with adultery in part because of statements she made to police. According to court papers she told an officer after her arrest:

"Officer I know what I did was inappropriate and I apologize but you'd understand if you knew what my life was like. I have a transgender husband and we never have sex. One thing led to another."

Genesee County District Attorney Larry Friedman said deciding whether adultery should, or shouldn't, be a crime isn't his job. Nor that of police.

"Obviously people can wonder that about any offense but obviously we're not the ones that make the laws nor do we determine if existing laws should be continued,” D.A. Friedman said. “That's a legislative decision and its there."

Given the circumstances in this case, some neighbors agree with the decision to charge her with adultery.

"Oh yes I think they should," Loma Burshtynsky who lives near Farrall Park said. “To be out there in the public, definitely, definitely."

"I think she should, I mean if she's married,” Bastedo said. “Why do this if you're married?"

“I think she should be charged with adultery, I really do," Barton said.

The 41 year-old woman charged tells 13WHAM News that she didn't deny engaging in a sex act with the 29 year-old man who was with her. However, she said police are painting a picture that isn't accurate. She insists nobody was nearby and if they were that they would not have seen anything inappropriate.

The couple is due back in Batavia City Court Tuesday afternoon. D.A. Friedman said in 28 years as a lawyer this is just the second time he's seen the adultery charge used. Adultery is a Class B Misdemeanor and carries a maximum penalty of up to three months in jail. Public Lewdness is also a Class B Misdemeanor carrying the same penalty.

They perps look like they were tweaking some kind of drugs. Then they throw in her having a transgender husband. I don’t even know what that is, but she certainly had the option of a divorce. I guess it’s only a matter of time before they get invitations from Jerry Springer.

Well, just asking, but couldn’t she have “L” sex with her “LGBT” capital “T husband?

And, although she looks sorta guilty in that photo, I could see where she might have been a not guilty 20 years ago.

my ex lived in Batavia and let me tell you when I stayed up there that sort of thing was common place. The place was a liberal utopia. Everyone and his mother on food stamps, no jobs besides drug dealing, crippling taxes, and more “lgbt” than I thought was possible in such a small area. Made Massachusetts seem like a randian paradise.

Suffice to say when she wouldn’t leave with me the relationship went sour real quick.

I lived in Batavia not long ago. It’s a quiet little middle of nowhere city of farmers, where such rank public lewdness coupled with transgender (aka voluntary genital mutilation) issues is so far “out there” it doesn’t even count as fringe. It’s the kind of place where living there 10 years counts as “newcomer”, where “conservative” is left of center.

Dang, that story is just freaky for the area.

Listed his name and all the words he added.
Some folks think that the keyword list is posted anonymously.

Certainly messes up keyword searches.
