Texas Governor Calls for Article V Constitutional Convention

Abbott explained, "We combed through the Federalist Papers and the Anti-Federalist Papers, through court decisions from Chief Justice John Jay through Chief Justice John Roberts. Through every scrap of relevant materials all the way up to the executive office. We distilled the information into nine amendments to the Constitution that will restore the Rule of Law in America. We call it: The Texas Plan."

Republican presidential candidate Sen. Marco Rubio (R-FL) recently said he would support a constitutional convention to get term limits for members of Congress and federal judges and a balanced budget amendment, but the 100 page plan by Abbott is a serious, comprehensive, and detailed plan.

We just need a few more governors to ask for this at the same time, right? And there can't be too many of them opposed, right? And they all have to set the agenda first, right? Maybe Trump could offer up a neutral venue?

The problems with his plan is that it doesn’t go far enough. It should have term limits for Representatives, repeal the 17th Amendment, make Supreme Court justices serve a single 10 year term, more narrowly define the “interstate commerce clause”, and allowing Congress to override a alphabet rule change or EO (not a repeal of an existing rule) with a simple majority vote that doesn’t have to be signed into law by the president. Also, all federal laws and agency rules are to expire after 10 years. If they are important, they can keep passing them.

Who has the enforcement power? Answer: the states via the threat of an Article V convention to take matters into their own hands.

Governors who harbor a desire for the Presidency may not approve of Article V. Also it is hoped that most state legislators do not aspire to national office. Granted, that’s not a proven assumption.

and why would they abide by new amendments. The government needs to have their feet held to the fire to obey the current constitution. This could be done by revisiting the declaration...

Plus The left will try to add draconian amendments.

The left or the GOPe can try to add,mid the rules of the convention allow. Besides 3/4ths of the states have to approve each amendment individually before it can be added.

A constitutional Convention is NOT just talking about new amendments. It’s extremely dangerous in the present political climate.

Why in the world would anyone think a Con Con is a good idea, if they’ve read Matthew Bracken’s books? Amendments, yes, Con Con no.
