Twin says he committed murder that got his brother prison time

A Chicago man has made a stunning confession — insisting he committed a 2003 murder that his identical twin brother was thrown in prison for 13 years ago.

“I’m here to confess to a crime I committed that he was wrongly accused of,” Karl Smith, 38, told a Chicago judge last week, as his identical twin, Kevin Dugar, dabbed tears from his eyes from his heavily guarded seat in the courtroom.

But could these two brothers — so identical that for years they impersonated each other for fun — simply be pulling a fast one on authorities?

The “identical nature” of their relationship is irrelevant here in whether the now-confessing sibling is guilty or not and whether the poor brother should be released somehow.

Look into the legal aspect. Is there a statute of limitations. Can the now-confessing brother be legally charged or not? How alike the two are has no legal bearing according to indictment, trial, conviction, sentencing and/or freeing of the ‘wrongfully’ convicted other brother.

If the real supposed killer can’t be put on trial and jailed, then his confession is BS and his brother should stay in prison.

This sounds like a defense used when two people are involved in a murder, and the evidence doesn't conclusively identify one of them as the murderer.

In separate trials, each perpetrator blames the other. And, the other takes the 5th -- thus creating reasonable doubt for both. It's one reason prosecutors want to try both at the same time.

This was the basis of the plot in The Onion Field.

I don't believe there is a statute of limitation on a prosecution for murder.

As I wrote above, I think this is a case where they are simply trying to create reasonable doubt, so that neither can be convicted.

I was mainly speaking about the writer’s conclusion that the confessor couldn’t be convicted because of their being identical. A believable confession would negate that IMO.

Will it be Hillary at the debate tomorrow, or her double?

If it’s her double, how could that be proven?

I see no way to prove it - to get legal access to do so.

Then what happens? She’ll be full of energy and healthy, in front of a hundred million people, and accepted by the country as the real Hillary. Does she then actually run for President?

This could be a nightmare.

Who will we really be seeing tomorrow night?

Ah, I see your point. That's an interesting wrinkle -- I be curious if there is a legal angle we are missing that would protect the confessor, or at least reduce his sentence.

The article doesn't describe the current sentence. Perhaps it's a life sentence, and the twin is hoping for a lighter one? If so, that's a pretty big gamble.

To my mind, the “identical twin” thing without fingerprints or DNA evidence could only work in a first-time “neither one of them can be proven guilty” scenario. The gambit worsens infinitely after the trial, IMO.

I’d say, put them both in prison - it’s the only way you can be sure. :0)

The two are very much identical, even as adults. Usually, the identical aspect fades over time. People gain or lose weight at their own pace once reaching adulthood. My question is why did twin #2. wait so long to confess, and what prompted him to finally step forward now? The mother says’”He wouldn’t lie about something like that!”. Oh really? I think he just spent the last 13 years lying about something exactly ‘like that’.
I say his confession changes nothing without supporting evidence. It’s almost a cruel joke of phony rescue.

Second question is; Were the illegal activities of the two men also ‘identical’ in style and motive? If they are both
violent hoods, then society does not win trading one for the other.
