The Federal end running the 10th Amendment to make hemp and the related plants illegal was a bad idea.
At least with prohibition they respected the Constitution enough to amend it. That has not been the case since.
Heroin is a foreign product ... the federal actually has lawful power to prevent its importation. None is given it to regulate commerce, industry or agriculture within any State. Even the power respecting interstate commerce only existed to let the federal prevent States from abusing their powers as the expense of other States and their citizens, not so it could “regulate” in the post-FDR sense interstate commerce.
