Upon signing of the spending bill, the President sent a letter to the Speaker of the House of Representatives and the President of the Senate. The President hereby designate as an emergency requirement ALL funding so designated by the Congress in the Act pursuant to section 251(b)(2)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985, for the accounts referenced in section 7058(d)

What is the meaning and purpose of the President’s letter?

A John Salisbury tweeted out this explanation. Could not find any MSM reference (of course not). The letter from the President is copied below with reference. For those who do have time, the conclusion of Mr. Salisbury . . . The President has basically told the house . . . See ya in court!

For those who have given up, patriots all in the trenches, understand, North Korea has stood down, only the details follow. Up next is Iran. The President needs what he got from that bill to accomplish what is going to be confronted in the next 3 to 4 months. Hang on folks. Its show time

 Let's talk about what the President can and can't do for this Omnibus Bill. There's a lot of discussion both ways so let's examine how money gets allocated & spent in the US Government:

1. Congress allocates money to be spent. The President spends the allocated money.
2. Once Congress allocates money, their job is oversight of the money being spent. They don't spend the money and have no say HOW it gets spent as long as it's spent legally. That's their job to monitor with oversight.
3. Once the President is given the money with the instructions to spend it, he has a number of choices to make in spending it. There are some rules he has to follow & some of the money is fungible and some isn't.

4. However there are some other factors that are in play here. One of them is that the President has declared a Human Rights Emergency AND has notified Congress that he's invoking the Balanced Budget and Emergency Deficit Control Act of 1985.

NOTE: See Letter and Link below for reference of above statement.

5. This opens up new options.

6. By making these two declarations President Trump has just communicated that he has the authority to NOT spend any funds he doesn't deem necessary and will return them to the US Treasury. So, funds for Planned Parenthood? He can simply not allocate the funds
7. Also, these declarations make some funds fungible. For instance if he determines that building a Wall on the Southern Border is a defense against Human Trafficking? He can move funds from anywhere else in the Defense Dept Allocation & simply build the Wall.

8. Congress is powerless to stop cash reallocations on an omnibus bill AND cannot stop the DOD from taking measures under a declared Emergency.

NOTE: In part the above statement needs to be challenged,

9. Despite their language in the Omnibus Bill about the Border Wall, it is trumped by the State of Emergency that Trump declared

8) (sic)So in summary - This will go to the Courts. Congress will sue the President over the Border Wall. But here's how it will play out - Congress and the President are co-equal branches with different functions. Congress allocates. The President spends.
9) (sic) The President has National Security as his Primary Responsibility and it's his job to use whatever funds and declarations he needs to for that job. No Court in this Nation (except corrupt on the take Judges) would EVER rule against a President for exercising that authority.
10) In the end the Supreme Court (yes, that's where it will end) will fully VALIDATE the President's Constitutional Authority & the Wall will be built. /

In plain English, President Trump just used an obscure 32-year-old law to roll the demonrats.

He’s going to spend the cash as he sees fit. If they don’t like that they can go pound sand.

Bawahahaha.

If this is true, I BEG Congress to take the President to court, on this whole travesty, but especially the Wall.

That will give him the chance and the time to call out each and every Republican hack that voted in favor of this debacle, so that they can explain it to their constituents.

It will give him a chance to call out Schumer and ask why the rest of the country needs to borrow billions for tunnels that aren’t needed and folks that will never use them, have to pay for them.

It will give him time to have all the Republican’s that have campaigned against Planned Parenthood, a chance to explain they voted to borrow $500 million, to give to PP.

If this is true, then Ryan, McConnell, Schumer, Pelosi, et al, probably have EMS standing by for all the head that will explode and all the strokes that are about to happen. It’ll be like a mass casualty even, with a shot being fired or explosion.

If this is true, then I’m thinking we could see a lot more people retiring/resigning, as they begin to accept that the ‘status quo’ just isn’t going to cut it anymore. Let’s hope.

If this is true, then he completely outsmarted them, at their own game with something they didn’t remember or even know about. So there’s a good chance some of them are doing the, Surrender Cobra, right now and their staffers are rifling thru books to see if this is legitimate.

If this is true then, once again, he has outsmarted a lot of people, me included.

As much as I wish he would have just vetoed the thing and called them all out, he still risked an override. This way, they have no out. Kind of like having charges dropped/dismissed or being acquitted of all charges.

Can’t recall what radio station I was listening to yesterday while driving around town, possibly the Patriot 1150 in So Cal. But some Lady was taking about 10’s of thousands of Sex Slave workers sneaking accross or forced accross the Southern boarder. Sure sounds like a Human Rights situation. Coincidence I was hearing about that yesterday?

If you or Trump are counting on this you haven’t been paying attention. When the Judicial Branch egregiously violated the Executive’s legal authority the Executive failed to slap them down. They will now rule as they damn well please.

I take back every curse word I expended on this magnificent philander for the past day and a half.

We knew when we voted for the Donald, he cheated on his first two wives, and probably cheated on his third one.

The only person that thought she could convert him to fidelity was his current wife, and she probably has arrived at the Mrs. Kobie Bryant resolution.

Why isn’t the letter signed? There are no other references to it so far. One of the tweeters in the link asks if he (Trump, I’m guessing) will do it. It doesn’t sounds as though it has actually happened. Is Salisbury replying to someone else? I’m trying to backtrack but am not conversant in tweeting.
