Passenger on deadly Southwest flight files lawsuit: 'She prayed and feared for her life'

One of the passengers on the Southwest flight which made an emergency landing following engine failure has filed a lawsuit against the airline, as well as the makers of the plane and engine. When the engine exploded, pieces of it blew out a window on the plane, causing a woman to be killed when she was partially sucked out the window.

Lilia Chavez filed suit against Southwest Airlines, GE Aviation, Safran Aircraft Engines and CFM International, a supplier of jet engines, in the Eastern District of Pennsylvania on Thursday. Chavez alleges in the lawsuit that the companies "unforgivably breached" the trust of passengers who "entrust their lives and safety, to entities such as Southwest and the CFM Defendants."

Jennifer Riordan, 43, was the first person to die on an American airline in almost 10 years in the April 17 incident. The plane, destined for Dallas, had taken off from LaGuardia International Airport in New York when the engine blew about 20 minutes into the flight. The pilot managed to safely land the plane in Philadelphia.

Chavez was sitting three rows behind where Riordan was partially sucked out the window, the lawsuit says.

"Ms. Chavez witnessed the horror as the force of the depressurization pulled an innocent passenger partially through the shattered window and she watched as passengers risked their lives to pull the passenger back into the aircraft and save her life," the lawsuit says.

According to Chavez, the cabin became "a whirlwind of airflow and airborne debris which struck Ms. Chavez and obstructed her breathing."

In the filing, Chavez says she "prayed and feared for her life" and she called her children to tell them she loved them and was preparing to die. Once the flight landed, Chavez alleges workers for Southwest did not appropriately care for her and fellow passengers.

Frankly I'm surprised it took this long. Unless I missed something about other lawsuits being filed.

She can do both. I don’t ask for much when I take a flight but not seeing a woman sucked through a window and then pulled back in dead isn’t too much to ask.

Under ‘NORMAL’ circumstances and times I could not believe it would go anywhere unless the airline is found to be GROSSLY negligent.

The ‘other’ FR is correct, they all should be praying for their good fortune and if not in the praying attitude, at least thank their lucky stars that the Pilot had the wherewithal to keep the plane under control and safely land it.

I don’t think the family of the person who died has a suit either.

The way things are headed, soldiers and or their families will be suing for injuries and or deaths on the battlefield.

“I didn’t join to go to war, I joined to go to college” OH, that’s right, they already used that one FOUR years after 9/11 in which anyone that was in sort of had to know what was going on...

The Riordan family is Catholic and has announced they will not sue is my understanding. They know they’ll see her again and they’ll miss her very much, I think the dad said. Classy and refreshing.

Life is a risk from the day you are born. Flying on Southwest is safe, very safe. Driving from New York to Dallas is multiple times more dangerous than flying Southwest. The passenger’s family must certainly be compensated. Those that were not injured are simply parasites. I worked in the oilfields in offshore exploration for 17 years before becoming a pharmacist. I saw tragic accidents, one poor bastard burned alive. I did not sue my company for psychological trauma. I just did my job.

The company that is in real jeopardy is the one that designed and built the turbine. Turbines fail catastrophically on extremely rare occasions. The containment ring for this did not contain the failure. I suspect an engineering design failure. It must be mentioned that this turbine has a stellar record of safe performance.

It will probably take a year, but the NTSB will determine exactly the reason for this turbine failure and why the containment ring did not contain the disintegration of the turbine.

You do realize air travel is one of the safest forms of transportation, and has never been safer then it is today right? Sometimes shit happens. She should be glad the pilot did a stellar job of getting them on the ground ALIVE.

I’m a pilot. I have been flying for a very long time. The pilot in command of this aircraft did a fantastic job of keeping everyone, except one, alive and putting them back on the ground safe and sound.

This is like saying that when you find yourself in any situation that you can not deal with that it always has to be someone’s fault and you are going to sue the hell out of them.

No one in this did anything intentionally do cause anyone else harm. Accidents do happen and life is never perfect.

PTSD. Really? I have survived many situations where life reached up and smacked the hell out of me and I had to learn to deal with it.

If you are alive after something like this first be thankful.

I keep reading that she was sucked out the window. Wouldn’t she have actually been pushed out by the high internal pressure trying to equalize with the low external pressure?
