Wonder why the guy who videoed it is in trouble and the underage kids who were actually doing the act appear to be off the hook?
There are those who argue the case that if the kids themselves had videoed the act there should be no criminal charge.
And yet if it is legal in a state for an 18 year old to have sex with a 16 or 17 year old then it would/should be criminal to record the act.
And yet even when homosexual sex acts were illegal, video recordings of those acts was not illegal or “obscenity”.
And there were states where bestiality was not criminal but video recordings of it were on the grounds of obscenity.
