Oxford student wrongly accused of rape endured two years of hell because police were too busy with Jimmy Savile cases
An Oxford University student spent two years on bail accused of rape because police claimed they were too busy dealing with other reports in the wake of the Jimmy Savile scandal, a damning report has revealed.
Oliver Mears, 19, was accused of raping a woman at a house party in July 2015, but was not charged until June 2017.
Just days before he was due to stand trial in January this year, prosecutors announced they were dropping the case due to insufficient evidence.
The Crown Prosecution Service (CPS) has admitted the police and lawyers had made a string of blunders which had prolonged Mr Mears' ordeal.
Details of the failings have now been revealed after a letter of explanation sent to the trial judge was obtained through a Freedom of Information request.
In the letter a senior prosecutor explained that Mr Mears - who was studying Chemistry at St Hugh's College, Oxford - had been accused of rape in July 2015, but Surrey Police had not passed a file of evidence to the CPS, for a charging decision until May 2017.
The letter said: Surrey Police have accepted that the investigation was protracted and subject to various delays.
"The delay in the investigation was as a result of the rapid rise in complaints being made to the Surrey Police force post Savile.
A rape specialist prosecutor then authorised the decision to charge, Mr Mears, weeks later on 21 June 2017.
After the case collapsed, the trial judge Jonathan Black at Guildford Crown Court, demanded an explanation as to what had gone wrong.

Now the accused has missed part of his education; when he returns, he will be older than his classmates; and marked
as “accused of rape” for the rest of his life and career.
Wonderful. British justice is just as biased as our own.
Heaven help anyone caught up in it.
Apparently, Nifonging isn’t exclusive to this side of the pond.
Sounds like the solution is to fire the ‘rape specialist prosecutor’.
Without looking, I’m guessing a feminist; better than even odds a lezbo.
I guess “due process” doesn’t exist in Old Blighty!
Unlike those peasants who worship royalty across the water, we have a Constitution that guarantees a speedy trial. They have basically nothing to protect their rights.
And the name of the accused is always released. In cases like this one, the name of the accuser should be released. Fake rape allegations make it much more difficult for victims of real sexual assault.
“Unlike those peasants who worship royalty across the water, we have a Constitution that guarantees a speedy trial.”
Except in some states, like North Carolina, where an inmate was jailed for 4 and a half years awaiting trial, and it was ruled not to be a violation of his right to a speedy trial, because it wasn’t a deliberate delay, the courts were just too crowded to get to his case...
(North Carolina was also the site of the infamous Duke lacrosse case... built around a crime that never happened.)
Well, at least our rights are written down somewhere :)
I imagine being stigmatized will do that.
Like what happened to the bikers at Twin Peaks in Waco? /s
Like the mattress carrying whore.
That's a fine excuse after the British police turned a blind eye to Savile for decades.
When it comes to women making accusations against men, nowhere has due process.
And it neds to damn well change and the liars need to be jailed for a sentence as long as the crime they are lying about.
I knew he was innocent as soon as I saw his name. :-)
“and it was ruled not to be a violation of his right to a speedy trial, because it wasnt a deliberate delay”
Sounds like the Hillary ruling...no obstruction as there was no intent to obstruct.
Probably a reaction to Clinton raping female students and leaving country.
