The framers of the Constitution addressed the need to amend the contract between the people and their government in the future. Article V describes the process for amending the document. If Cuomo truly wishes to provide Constitutional protection for the killing of a baby in the womb, he is free to begin the amendment process. Once the right to abortion at will is enshrined in the document, courts will not be able to prohibit abortion.

The Constitution does not give the Supreme Court, and other federal courts, the power to change or amend the Constitution. That power has been created by the decree of the court and the failure of the two other co-equal branches of government to stop this usurpation of power by the judicial branch.

As others have noted, states have the power to make abortions legal within their borders. In the highly unlikely event the Supreme Court reverses Roe v. Wade, New York is free to pass a law giving anyone in the state the right to have an abortion.
