IF the chief is telling the truth, and IF the paper is reporting properly, the top of the indictment should be for two counts of first degree murder. Maybe a count of animal cruelty, some perjury, burglary, official oppression (or whatever the Texas equivalent is).
Oops, I forgot. They also need to charge him with aggravated battery on a peace officer for the cops that got wounded.

18USC242 is the relevant Federal statute. The death penalty is available if the crime is committed while armed and under official authority.
The Feds should step in and use that.
