Destroying the Electoral College: The Anti-Federalist National Popular Vote Scheme
The Heritage Foundation ^ | October 27, 2011 | Hans von Spakovsky

Posted on 03/04/2019 5:42:28 AM PST by jjotto

[From 2011] Abstract: The National Popular Vote (NPV) plan is the latest in a long line of schemes designed to replace the Electoral College...

...The NPV, at face value, may appeal to traditionally democratic notions of “every vote being equal.” Yet its supporters seemingly have no concern for the many other non-majoritarian aspects of the governmental structure established by the Constitution...

...Supporters of the NPV claim that because the Constitution gives state legislatures the power to determine how electors are chosen, the NPV is constitutional and requires no approval by Congress. Such claims, however, are specious.

The NPV is unconstitutional because it would give a group of states with a majority of electoral votes “the power to overturn the explicit decision of the Framers against direct election. Since that power does not conform to the constitutional means of changing the original decisions of the framers, NPV could not be a legitimate innovation.”

...the NPV aims to control the behavior of compacting and non-compacting states alike and “harms those states whose citizens benefit from the current system of election.”

Should the NPV movement reach its target of 270 electoral votes, states not involved in the compact will have been co-opted into an electoral regime despite having never consented to the compact. This distinction delineates this compact from others...

Long read from 2011 excerpted. A serious look at the NPV and the problems with it.

Just another attack on states rights. Looks like they were right back in 1789 to be fearful of being swallowed up by the more populous states...

So far it just seems to be blue states so it seems to be an effort to prevent further collapses of “The Blue Wall”. I bet the first time a state switches its votes due to this agreement many voters will take it to court.

Thinking like a liberal:

Using presidential powers to declare a national emergency: unconstitutional.

Disenfranchising millions of voters with a scheme to circumvent the Electoral College: constitutional.

There’s also this scholarly treatment of the NPV in a PDF from the Cato Institute in 2008:

The Electoral College “firewalls” vote fraud; no matter how many fraudulent ballots are generated in a given state, that state gets no more electoral votes.

Without that limitation, the democrat-controlled urban vote plantations will be cranking-out fraudulent ballots by the truckload, guaranteeing a popular-vote victory for the ‘rat candidate.

It’s all about maximizing the impact of illegal alien voting.

The EC prevents a state like California from choosing to import millions of illegals and having those illegal votes change the outcome of a federal election.

Yes. They were absolutely right to avoid pure democracy = tyranny of the majority.

At this point in our history, we have cities and states declaring themselves ‘sanctuaries’ for illegal aliens - some allowing them to vote in local elections (which clearly means they won't be excluded from voting in national elections). These cities and states refuse to comply with federal law, and yet have an increasing input into federal elections because they count illegals in their census - and thus receive more Congressional seats. They are already overrepresented. Why in the world would it be OK to give them even more power by doing an end-around the Electoral College?

Good find!

From the source:

...James Madison, chief architect of our nation’s electoral college, wanted to protect each citizen against the most insidious tyranny that arises in democracies: the massed power of fellow citizens banded together in a dominant bloc.

As Madison explained in The Federalist Papers (Number X), “a well-constructed Union” must, above all else, “break and control the violence of faction,” especially “the superior force of an . . . overbearing majority.”

In any democracy, a majority’s power threatens minorities. It threatens their rights, their property, and sometimes their lives...

Ultimately, if you want to maximally empower an individual voter, to create the greatest probability that a single individual, by their one vote, can change the outcome of an election, the Electoral College is the way to go.

The cabal behind the NPV doesn’t want that; they want to industrialize election-rigging on a national scale.

“I bet the first time a state switches its votes due to this agreement many voters will take it to court.”

It’s clearly unconstitutional but the aftermath of a Presidential election is not the time to fight it. This BS needs to be smacked down now. Imagine the scenario of a Presidential Election hanging in the balance with Robers basically picking the President.

Precisely!

The NPV commies want every vote to count, especially the mult-voter (vote more than once in an election) votes; the illegal alien votes, the deceased votes; and the felon votes.

I suppose voter id is also “immoral.” Must ask San-Fran-Nan Pelousy, the arbiter of morality.

There is a technical term for the National Popular Vote (NPV) proposal - A Cockamamie Scheme.

It will certainly destroy the basic fabric of our Republic. Of course, this is exactly what the Democrats intend to do. If this scheme was adopted and if it survives the Constitutional challenges, our Republic and the Constitution would become dead letters and the Democrats would have an unassailable advantage in the political equation. We would become what much of Europe has already reached.

The outcome is in doubt, but is most likely results include:

1. This effort will fall short of the required states to trigger the scheme.

2. If the scheme succeeds, Constitutional challenges will ensue and a series of injunctions will prevent it’s use during a Presidential election until the matter is resolved by the Supreme Court.

3. The Supreme Court will find that this compact is not Constitutional.

4. The Democrats will continue to contrive various illegal schemes to capture power that they currently cannot achieve through Constitutional means.

5. The Democrat efforts to obtain power through corruption and voter fraud are more likely to succeed than this scheme.
