There is no case here as the DOJ has withdrawn its case.
The DoJ can only withdraw its case with leave of the court. The case is not dismissed until a judge says it is. This petitition seeks to have the Circuit Court to order the District judge to get is mind right.
Sometimes the reasons the government has laid out for dismissal are so blatantly obvious, there is no room for a judges discretion. To not dismiss the Flynn case is an abuse of discretion.
Though there really isn't a controversy, not even the smattering of one, the intellectuals who run the country have driven this case so far off the rails that it wouldn't surprise me if the Court of Appeal rules either to send the case back to Sullivan with an Order to Dismiss (which he can then waste more time) or sends it back to Sullivan to continue feeding Flynn to the lions.
Flynn must be exonerated in a Court of law so that he can participate in government again, protect himself with firearms again, and maybe go after the Obama Coupsters in a Civil case.
Were it the full court, Flynn would have been screwed. It’s only a 3 Judge Panel, and it includes a GHW Bush Appointee, an Obama appointee and a Trump appointee. I don’t think there is any real chance it would be reviewed by the full court after this. The decision will be final, either way. Flynn was lucky to get 2 good judges on the panel.
