The Michigan Court of Appeals ordered the release of a Black 15-year-old who was detained for failing to complete schoolwork during the pandemic, a case that had drawn nationwide attention and scrutiny.
Detroit News reports that the court overturned a previous ruling that said the teen violated her probation by missing homework. The court blasted the previous ruling, calling it "callous" and ordered the teen, known only as Grace, to be immediately released to her mother's custody.
A report by ProPublica earlier this month first shed light on Grace's case, as it noted that she was on probation for fighting with her mother and stealing, but there were reportedly no other examples of students taken into custody for failing to complete schoolwork.
The Black teen's teacher and many others said it has not been uncommon for students to miss work while remote learning during coronavirus-related school closures, and ProPublica reported that she is diagnosed with a learning disability - attention-deficit hyperactivity disorder.

Judge Mary Ellen Brennan of the Oakland Circuit Court had ruled last week that she must stay in detention, drawing the ire of Rep. Debbie Dingell (D-Mich.) who suggested race factored into the punishment.

Was that fighting, as in arguing or assault.
This teen was on probation.
There is wide latitude to set conditions before granting probation.
It would help to know the offense the teen was on probation for.

They know. Knowing and caring are two different things. Kids like that, angry, fighting their parent, deliberately failing just don’t care. Grades motivate people that believe they have a future.
I wouldn't rule out the possibility that "the court" figured out that a juvenile detention center might provide a better environment for her than her home does.
Parents cant deal with their young people. They have been begging someone to take teens off their hands.
I thought it was her abusing her mother who was making her do her homework and she kept refusing. It got so bad she had to call the cops. The media of course took things out of context and said it was all about not doing her homework when in fact it was about her striking out against her mother.
There was a post about this a few weeks ago. The kid agreed to complete schoolwork as part of a probation agreement. When she did not comply with her contract, she was re-arrested and put in detention.
I guess according to Dingell, breaking a legal contract is OK if your skin is the right color.
My sister teaches black (NOT Black) middle school kids math in Baltimore. Over two-thirds of her classes would be behind bars for not doing homework if that were a criminal offense
Wow. She was on probation for assault and theft. She was in detention. She kept using drugs. Some dip officer put the homework thing on the list of violations on the DR and that alone becomes the story.
Dont let the press fool you. This whole article is an obfuscation of reality.
Kids miss school work while attending public schools.

Wow! If this happened when I was a kid I would still be in jail. My parents did not believe in homework and did not care if I did it or not.
