Woman crushed to death by heavy machinery while lying on Oceanside [CA] beach, police say

Oceanside Police Department told FOX 5 the woman was lying on the sand at Oceanside Harbor Beach around 10 a.m. A worker operating a tractor didnt see the woman sleeping and ran her over, according to police.
The woman, who appeared to be in her 40s, did not have identification on her. SkyFOX video showed crime scene tape and police officers surrounding the tractor. It was being used to move pipes as part of a dredging project.

A woman was lying on the sand on the beach? How was the tractor operator to know a person would try to lay on the sand at the beach?

That's a shame.
I spent a lot of time on Oceanside Beach during the early 1980s when I was stationed at Camp Pendleton. Used to walk there from my barracks at 21 Area.
Good memories there. They had a decent library as well.

Is this a crime? It could be if the driver was criminally negligent. Apparently the woman was intoxicated and passed out. (Also "fully clothed".) The beach appears to be open to bathers. Other bathers noticed her, and thought she was in bad shape.
