Guadagno accepts judge's ruling on Cruz ballot eligibility (New Jersey)

Lt. Gov. Kim Guadagno has accepted an administrative law judge’s decision ruling that Sen. Ted Cruz meets the criteria for a natural born citizen and should be allowed to run in New Jersey’s GOP presidential primary on June 7.

“After full consideration of the record, as well as Judge Masin’s thorough and well researched initial decision and the exceptions filed with my office, I, Lt. Governor Kim Guadagno, as Secretary of State and chief election official of the State of New Jersey, adopt Judge Masin’s initial decision in its entirety,” Guadagno said in a statement posted to the state Division of Elections website.

Two parties had filed challenges to the Texas senator’s eligibility to run for the Republican presidential nomination: Victor Williams, a Washington, D.C, law professor running as a write-in candidate for President, and a trio of “concerned citizens” from South Jersey. Both contended that Cruz is not a natural born citizen, one of three constitutional requirements for the presidency, because he was born in Canada.

Cruz’s mother, who was born in Delaware, was a U.S. citizen at the time of his birth. Cruz has said that a child of a U.S. citizen is automatically granted citizenship at birth and is therefore “natural born.”

Administrative law judge Jeff Masin heard arguments on the matter Monday. He ruled Tuesday that Cruz is a natural born citizen within the meaning of the Constitution. He rejected Cruz attorney Shalom Stone’s arguments, however, that the objectors did not have standing to bring their challenge, and that the secretary of state did not have authority to consider the matter.

I really hope the Supreme Court (eventually) ends up taking that appeal from Pa.. I think it is a garbage argument but it is something that needs to be settled because the fact that it is unsettled may adversely impact a Presidential election someday.

Your point is well-considered.

The state courts only have authority -- (though when has that ever stopped any activist judge!) -- to rule on questions about meeting the qualifications to run for national office.

Meeting the qualifications to serve in a national office is a Constitutional question that must be addressed at the federal judiciary level.

how many times did gay marriage lose in Court before it was legal..... how many times did lose before it finally won?....

it won when the people in power wanted it to win

Do you really think Hillary and the dems won't be able to shop a judge to get this through when they need it ...when the time is right...

it will go to the Supreme Court when the people in power have the need to block Cruz

wake up you live in a country where Hillary can get away with murder what legal parsing and justification .... so do you think they can get Cruz ruled not NBC when and if needed?.....

how can anyone that's been paying attention to our court system not know that if certain powerful people want something rule one way ....and they have any room for justification .....they can get exactly want they want when it's convenient....Cruz is supposed to be a threat to DC power structure that's the kind of thing in history has gotten people killed....so a little pressure on our court system to have a rule that we want it's no big deal

Birthee for eight years after Obama have established the precedent in the public mind that if you're born in a foreign country you're not NBC

.that's what they were trying to prove... Obama was born in Kenya so not NBC... so the publisher won't question it now

and the law can be interpreted the way DC power ...they can rule Cruz’ eligibility any way they want

they're just waiting for the time when everybody’s got their chips in the pot ... for the time for the best advantage ....they'll never pull the plug on him till he the nominee at minimal....

if the GOPe or the Dem pulled the plug Cruz now...then Trump is guaranteed to get the nomination.... and they don't want that

But if Cruz get the nomination watch who they pick for VP .....and then once the conventions closed all the sudden a few week after ...this constitutional crisis arises ...and Cruz is ruled ineligible....so who the GOPe hand picked person they put in his place?

and of course if the Dems thought they were going to lose to Cruz sometime during the general ...they do the same thing too

You are on the money, but if the SC gets this, the VP choice cannot be Rubio or the pretzel-twisting decision to kick Cruz out and keep Rubio in will rival Roberts on the ACA ‘tax.’

I, myself, have consistently maintained that Ted Cruz is an NBC, under my understanding of the law.

Unfortunately, that doesn't mean that the Democrats won't try to use it against Cruz if he were the nominee.

Ted Cruz is eligible to be President, but he's not suitable to be.

Ted Cruz is not viable in this anti-establishment wave: not after being endorsed by the entire liberal wing of the GOPe (Romney, McCain, Jeb, Lindsay) and hiring the likes of Neil Bush (!) to his finance team.
