Will Chris Christie Body-Block Ted Cruz From New Jersey Ballot

BETHESDA, Md., April 15, 2016 /PRNewswire-USNewswire/ -- Washington D.C. Law Professor Victor Williams has filed an Emergency Petition with New Jersey Governor Chris Christie demanding that the Canadian-born Ted Cruz be disqualified from the ballot. Ted Cruz was born in Calgary, Canada and held his resulting Canadian citizenship until May 2014. Scholars across the nation agree that Edward Rafael Cruz is not a "natural born [American] Citizen" as required by Article II of the U.S. Constitution.

Victor Williams charges that Ted Cruz falsely certified his constitutional eligibility for office to gain ballot access in states across the nation. Williams demands that Cruz be disqualified from New Jersey's June 7 ballot and from several other late-primary ballots. (California, Montana, Nebraska, New Jersey, Oregon, South Dakota, and Washington).

Lt. Gov. Kim Guadagno Rubber-Stamps a Specially Selected Hearing Judge's Pro-Cruz Decision

On April 11, at an Administrative Law Office hearing just outside Trenton, Williams personally argued that the Canadian-born Cruz was not a "natural born Citizen" and thus not eligible for the presidency.

It was no surprise to Williams when hearing judge Jeff Masin ruled in Cruz's favor finding that it was sufficient that Cruz's mother was an American citizen.

The retired Jeff Masin had been specially chosen ("recalled") by Chris Christie's Office of Administrative Law to preside over the hearing. Masin's long-held views on the issue were well known to all.

It was thus predictable that the specially chosen hearing judge would rule in Ted Cruz's favor.

It was also not surprising that the hearing judge was able to produce a detailed, 27-page ruling in a one-day period. Clearly, Mr. Masin had come prepared.

While Mr. Masin's decision was no surprise, it was shocking that Chris Christie's Lt. Governor Kim Guadagno rubber-stamped the pro-Cruz decision without genuine independent review of the decision and a fulsome investigation of the "special" appointment of Mr. Mason.

Williams demands that Christie and the New Jersey Attorney General conduct a review of the decision and launch an investigation of the appointment shenanigans.

Williams as Late-Entrant GOP Candidate Asserts "Competitor Candidate Standing" to Disqualify Cruz; The "Republican Lawrence Lessig" Puts His Law School Theory to Practice

Williams states that he is "giving Governor Chris Christie an opportunity to clean up the mess that his Lt. Governor and Office of Administrative Law have made."

If Chris Christie fails to take immediate action to reverse the erroneous decision, Williams's Emergency Petition notes that the next step in the election law is the Election Law's statutory route to the Appellate Division of the New Jersey Superior Court.

Williams is registered/declared as a "write-in" candidate for the GOP presidential nomination in multiple states, and thus he has unique "competitor candidate" legal standing to take action. His litigation strategy is as disruptive as election year 2016.

I would argue against pulling a Cruz in New Jersey.

Bad optics, and letting the 14 or 15 people that will vote for Cruz cast their votes is no skin off anybody's nose.

I don’t want this to happen. It is clear that Trump will destroy Cruz in this state. If Christie gets involved, Trump could have the same criticism that Cruz is having over Colorado.

Gov. Christie isn’t that type of person, that’s why him and Trump have been close friends for years, along with Dr. Carson...

Cruz has insulted New York Values, which includes a lot of New Jersey people and Cruz has insulted the Italian-American people, on which I am one of, and they don’t like Cruz...

Cruz will get ‘maybe’ 3 votes, the rest will be split between Trump and Kasich...

This is a great example. If a Cruz endorser had done this to Trump, Trump eould be whining about it. But now a Trumpite is doing it and they cheer.

This was stolen from Democrats. Look up Torricelli and New Jersey.

Williams is just putting out a press release here. The governor isn't part of the chain of appeal. He may or may not respond, he has no obligation to do so, and if I was in his shoes, I'd ignore the issue, or answer that appeal of the Sec. of state decision goes to Superior Court of NJ, Appellate Division. If he's pressed for an opinion, he could say that his understanding is that there are legal authorities on both sides of the question. Leave the ball in the air.

No. I beleive that natural born citizenship should be decided in a federal court, not by one state at a time.

We Trump supporters do not believe the ends justify the means, let Cruz appear on the ballot and compete for votes. Too bad the same couldn’t have happened in Colorado.

Lots of issues go through a state first, federal court later progression. RKBA cases against state laws, for example. The cases don't have to run through that course, but they often do.

At this stage of the nomination and election process, the cases involve state laws that pertain to ballot access. There is no federal law for ballot access, and the federal courts uniformly deny standing to people who argue that an ineligible person is on the ballot.

Fifty years ago this would have been an easy case. In fact, so easy that the circumstances of it coming up would unlikely exist. The NBC question would not have been advanced to this level of prominence by the collection of Congress, political parties, and academic hacks. The water has been seriously muddied since, much as it was and is with the RKBA.
