A nominee should not be asked questions about a potentially pending case. The purpose of interviewing and reviewing the background of the nominees is to ascertain philosophic perspectives, moral character, and the nominee’s ability to do the job. It is not to attempt to predetermine the outcome of specific matters.
Blumenthal should recuse himself from this process because he is demonstrating his ignorance, incompetence, and personal bias.
