MASS. | Repeal of 1913 law would let out-of-state couples wed, too

BOSTON -- Fresh off the success of defending gay marriage from its latest attack, advocates say they have one more fight in Massachusetts: repealing a 1913 law that bars same-sex couples in most other states from coming here to get married.

Some say the law -- which says couples cannot be married here unless their unions would be legal in their home states -- has its roots in the effort to block interracial marriage, and plan to try to get it repealed.

Valid in other states? ''This radical social experiment will be exported to the other 49 states,'' Kris Mineau, president of the Massachusetts Family Institute, said Friday. On Thursday, lawmakers killed an effort to let voters decide on a constitutional amendment to ban gay marriage.

Now attention turns to the 1913 law, which, if repealed, would mean gay couples from other states could legally marry in Massachusetts. The possible impact on other states is unknown. Most states prohibit gay marriage, but a Massachusetts certificate could provide the foundation for legal challenges.

Opponents of the 1913 law say it was approved as part of a deal with states that barred interracial marriages and didn't want couples fleeing to Massachusetts to marry. Others say there's little evidence to support that claim.

After gay marriage became legal in May 2004, hundreds of couples from other states came to Massachusetts to wed. But Romney directed municipal clerks not to give licenses to out-of-state couples, citing the 1913 law. So far, only Rhode Island allows its gay couples to wed in Massachusetts.

I read that the governor of MA was going to try and repeal this law. And LAMBDA is warming up right now for the civil trials to come.

You guys back home in America have no idea of what you are doing do you?

You are wondering why America's influence is declining worldwide and you are starting to see now that much of the world is not willing to follow you into the abyss.

These are dangerous, very dangerous waters that you are treading into and there is no way to undo it once it is done.

Their world is going to come crashing down around them the second the voters get a chance to express their opinion.

Many scumbag politicians have been waking up to the fact that they work for the people. Not the other way around. It just may take a few more years for them to realize it in MA.

Singapore wont follow you and neither will Poland. There are numerous other countries as well that wont be embracing gay marriage as the United States is.

And what I have to say is correct, America is marginalizing themselves.

The countries opposing this moral degeneracy are generally in sub-Saharan Africa and the Muslim world, not exactly the allies we need.

Most of the “industrialized world” is headed in the same direction as MA.

I’m not sure how Latin America is dealing with this issue.

In any case, it appears to be the wave of the future. Doesn’t make it right, but it does make it popular.

THe thing is, MA has no right to make law for other states. aWhich is exactly what this is doing. If a state has laws on the books that say marriage is between a man and a woman, who does MA think they are over riding those laws. They can’t. Not unless other states allow them to.

I hear you, and so many others do too. Unfortunately this is being put in place, We Americans have no say. The will not allow us to have a say.

I for one, do not know what it is going to take to wake up these narcissistic selfish people. A revolution? I pray not, but I also pray for an end to this slide into the abyss, and not for the end that winds up IN IT!!

They do that in MA as well. And every year it gets worse. They were bordering on it before but this year, it was a porn fest on display. And yes, lots of kids present. It is the saddest part of all this.
