Democrat Budget Bills Go To Governor - And Uncertain Fate (Dems Thumb Nose At Constitution Alert)

But Republicans accused Democrats of subverting the will of voters and setting a historic precedent for raising taxes in California, calling the maneuver "stunningly cynical." They warned that Democrats would soon increase other fees to make up for budget shortfalls if they are successful in their majority-vote plan.

"This is a very historic day," said Senate Republican Leader Dave Cogdill, of Modesto. "Certainly we've been a long time coming to this point where we have reached such frustration with the laws of this state, with the people and their will as it relates to how taxes should be raised, that you've decided to take an unprecedented step. Something we believe, quite frankly, is illegal and will be overturned quickly in the courts." >snip<

Even if the governor goes along, anti-tax groups said they would sue to stop the tax increases. They also promised to ask voters to negate the gasoline fee.

Its a historic day in California. The Democrats flouted the state constitution and did what it said they could not do. The next step is a lawsuit to block the illegal tax increases.

Whatever Red Arnold does or not do - the taxes will never be collected. The Dems budget plan is DOA.

That would've saved $15bn to $20bn per year and closed most of the budget gap right there.

They did that in Nevada a few years ago when the Nevada Supremes tossed out a state constitutional provision that prohibited a majority vote for tax increases. The California Dems want a test court case to allow them to do just that, no matter what the state constitution says. After all, the state constitution really says what the Democrats says its means. They violated their oath of office and they trampled on the state's highest law.

They can only block tax increases. The Democrats took away even that safeguard from them today. So much for the rule of law.

Actually, we have some pretty vocal GOPers in our legislature who get themselves some camera time on the Sacto stations.

I also imagine a few of them slipped a photo of Gray Davis under AH-nold’s door to remind him that the citizens have no trouble booting a governor out of office and that a veto of these measures would be in his best political interest.

Come to think of it, we have a constitutional right to boot our legislators out as well through recall. I have already emailed Lois Wolk, my assemblywoman, and advised her that I consider these roundabouts to take more of my money to be patently illegal and advising her that I will work toward her recall if these measures take effect.

Failing that, I am sure the Howard Jarvis Taxpayers Association are already at work on the legal briefs.

On those few occasions when the Austrian did the right thing, he would never admit an obvious, logical (and conservative) motive.

If Schwarzenegger refuses to play, he'll never admit an extraconstitutional objection.

The lawsuits will be filed if it becomes law. And a referendum will be initiated to repeal the gas fee increase. The Democrats want war - by golly, they'll get a war on their hands!

He'll just say the Democrats didn't make enough concessions. Conservatives and taxpayers rights groups aren't taking this assault upon the state constitution lying down.

He’ll say these are difficult times, blah blah blah...

just one more reason he signed the ban on .50 cal rifles, perhaps.

He knew this day would come. He is either with the enemy and that is what the dems in the state legislature are,, no matter how the media portray them, or.. his legacy is sealed either way.

CA is out of control and has been for a long time. The courts are one of the huge problems. As more and more judges ignore Constitutions and try to write their own laws, we get in deeper and deeper.
I have always believed one reason the Dems were willing to anything to get BO in this year was that he is hoping to be able to get some really whacked out, very young, very far left judges on the SCOTUS. That is when they will start destroying what is left of our Constitution and country.
Don’t be fooled by BO’s picks for his cabinet, he has to start out slowly.

Schwarzenegger said his objections were not so much to the Democrats' majority-vote approach as they were to what they left out.

Schwarzenegger said he wanted:

1) broader exemptions from state environmental regulations.
2) a streamlined permitting process
3) fewer requirements for state construction partnerships with private firms*.

* Fascist speak for large campaign contributors

Wait and see, all states are having problems. In New York the governor has proposed a budget with 137 new taxes!

The average cost of the taxpayer will be increased by $4,800.00 per year. It will also result in 1 our of every 10 jobs to be lost.
