Breaking News: Obama action against DOMA coming

A well-placed and trusted source tells me that, any minute now, Attorney General Eric Holder will issue a statement announcing that it will no longer defend so-called Defense of Marriage Act lawsuits in court. The source believes DOJ had come to the conclusion that heightened scrutiny would apply, and that these cases cannot be defended in court. A 530d letter has been sent to Congress informing it that, if it wants to defend the statute, it is free to do so. A case is pending now that has a filing deadline of March 11.

This is huge, folks. By definitively stating that gay men and lesbians deserve heightened scrutiny, the Obama administration is declaring that there is no government interest in perpetuating the discrimination aggrieved parties are trying to redress.

that combined with the 13% from racist blacks gives him a nice 15% approval :P

He doesn’t enforce the immigration laws, he doesn’t enforce voting rights laws against the Panthers. Why should he enforce marriage laws?

So... rule by Judicial Fiat AND by lawsuit (by choosing not to fight lawsuits)

What this means is that if you don’t like a law, file a lawsuit and then the government LETS YOU WIN.

You can’t marry you goat but you want to? file a lawsuit...

you want Obammycare but evil republicans want give it toyou? file a lawsuit.

I know the liberal view is that marriage discriminates, yadda, yadda, yadda. And that to them, it’s a minor technical change to say marriage should be just any two people, etc.

But, doesn’t all of this really call into question whether government or society is allowed to define marriage at all?
Even defining marriage as any two people discriminates against polygamy and group marriage.

I think that since they are forcing homosexual marriage through the courts, it does call into question whether any definition of marriage will be allowed to stand.

And who will key targets of future lawsuits be? Churches, because there is no mainstream religious organization which performs homosexual marriages. Will they be sued? I guess we’ll find out.

This is also huge: during the DADT repeal training last Friday, my boss and I were discussing that this is the one area in which, even after repeal of DADT, homosexuals in the military won’t be treated equally: “partner” benefits and military family housing.

A calculated and deliberate attempt to tear down the last piece of the wall that separates aberrant behavior from natural relationships. Just disgusting.

From the letter to Congress:

"Furthermore, pursuant to the President’s instructions, and upon further notification to Congress, I will instruct Department attorneys to advise courts in other pending DOMA litigation of the President’s and my conclusions that a heightened standard should apply, that Section 3 is unconstitutional under that standard and that the Department will cease defense of Section 3."

Yippee. The Executive Branch now decides what's constitutional.

I always thought it interesting but our minister does not perform any wedding ceremonies. Apparently it was an issue of many of his emails so he simply announced from the pulpit some time ago that he “chose not to”. Guess that is one way to get around it.
