A former Texas Supreme Court justice whose appointment by Gov. Rick Perry led to accusations of racial pandering was part of a Federal District Court decision Thursday to issue a new voting district map for Texas that will likely overturn the map proposed by the Texas Legislature and is designed to create ethnic voting districts for Latinos.
U.S. District Court Judge Xavier Rodriguez joined with another Latino justice from the three-justice federal panel — Clinton-appointee Judge Orlando Garcia — to issue the racially-drawn map, which has not yet been given final approval. Lawyers for the Democrats and Republicans were given the opportunity to comment on the map Friday, and the parties now await the court’s final decision.
The Houston Chronicle reports that the new state House and Senate district lines could cost Republicans six seats in the Texas Legislature in 2012, and Fox News reports that the GOP does not believe it will hold its 101-49 supermajority in the Texas House if the map was formally adopted.
Rodriguez, once a casual Democrat, was plucked from obscurity by Gov. Perry to ascend to the Texas Supreme Court in 2001. Conservatives worked to successfully defeat him in a 2002 primary that the Weekly Standard reported was “all about race.” To compensate for his defeat, Rodriguez was appointed to the Federal District Court for the Western District of Texas by then-Perry ally President George W. The third member of the three judge panel — Judge Jerry E. Smith of New Orleans — posted a map proposal different from that put forth by Garcia and Rodriguez. His proposal was much closer to that of the legislature’s.
The three judges prepared the maps because a federal appeals court in Washington, D.C. — which is ruling on whether the Texas Legislature’s original redistricting violated the U.S. Voting Rights Act — is not likely to reach a decision in time for the 2012 elections.
The release of the Rodriguez-Garcia map was met with swift condemnation from Lone Star Republicans.

The U.S. Senate confirmed the appointment late Thursday of Judge Xavier Rodriguez to federal judgeship in Texas.
Frank Montalvo was also appointed to a new seat in the Western District, currently set for El Paso.
Both were nominated for judgeships for the Western District of Texas. Senators Kay Bailey Hutchison and John Cornyn recommended the two to President Bush. Rodriguez was nominated to fill the vacancy left when Judge Edward Prado was named to the 5th U.S. Circuit Court of Appeals. Cornyn’s office said Rodriguez was approved on a voice vote.
“Frank Montalvo and Xavier Rodriguez will only add to the exceptional tradition of judicial excellence the Western District has long enjoyed,” Cornyn said Thursday night in a statement from Washington.
“Judge Rodriguez brings the qualifications and integrity to the bench that Texas and our nation need now,” Hutchison said.
Rodriguez, a San Antonio native, was appointed to the Texas Supreme Court by Gov. Rick Perry in 2000.
A partner with the firm since 1987, Rodriguez rejoined Fulbright & Jaworski’s San Antonio office in November 2002 after serving as a Justice on the Supreme Court of Texas, focusing on the areas of labor and employment law and general litigation.
Rodriguez has represented both corporations and individuals who have been sued by their present or past employees based on alleged discrimination, harassment, retaliation, breach of contract, or breach of a noncompetition agreement. In addition, Rodriguez has handled a variety of general and commercial litigation matters.

So there was a small hiatus where Rodriguez may not have been anticipating a step up (or covered his bases). Which proves what?
My mistake. It appears that some of Perry’s opponents are saying things that aren’t true. I don’t have a problem with Perry but also have no problem seeing (or supporting) candidates as they are, warts and all. No candidate is perfect on all issues. I’d support any of the GOP candidates against Obama.
I don’t think it will be long before the “courts” allow the “latinos” living in our country to declare themselves another “sovereign nation” like the Indians have. Get ready for it.
WRONG...Perry wanted him for the TX. Supreme Court but Steve Smith discovered that XAVIER did not have appellate court experience thus blowing the affirmative-action pick when he ran & won . THEN W put XAVIER at the FED COURT level. Perry tried to robo-call Smith out at the next election to get this solid rt-winger off the bench. He was opposed to the DREAM ACT in TX and racial quotas.NOW look at the legacy of affirmative action “LATINO DISTRICTS” ? Steve Smith is the attorney in charge to stop illegals from accessing grant money for secondary education in TX. and running again for TX. Supreme Court.
I wondered where this was coming from since it was utterly disingenous. Seems it is Ron Paul that is spreading this little falsehood. Especially since Paul being in D.C. should know EXACTLY who recommended Rodriquez to Bush.
I will vote for Repub nominee EXCEPT Romney. I really believe he is just a Repub Obama. I pray that primary voters make the right choice. ABR....PAHLEEEEZE.

True. But by appointing Rodriguez to the Texas State Court Rick Perry gave him the step up the ladder and addition to his resume which led to the Bush appointment.
We already have had one illegal-loving, compassionate conservative former Texas governor in the White House; we don't need another.

No it wasn’t. Why do you think The Bushes endorsed Kay Bailey against Perry. The Break came in 98 when Perry reused to pull an ad Rove thought would hurt Bush with Hispanics.

Now he and his henchmen are undertaking their most serious gamble. Rick Perry managed to shine in Texas without Rove’s permission, and now threatens to become the current Republican frontrunner without Rove’s blessing. This, Rove has decreed, must be stopped, even if his party is destroyed in the process.
The origins of the Rove grudge against Perry really matter only to a handful of people. Suffice it to say it stems from some decade-old feud over power and money. And Rove has lassoed the entire Bush family in on it. The former presidents Bush have made it a great point not to comment on the actions of their successors—Clinton and Obama, respectively. They think there is a nobility to staying out of the fray and not making things more difficult for the next commander in chief. Yet the Bushes have shown no compunction about doing just that to a fellow Republican and fellow Texan (though Perry is the only one of them actually born in the state).
While in the White House, Bush 2 and his aides regularly scoffed at Perry for reasons that were never fully clear, making fun of his syntax and intellectual prowess without any sense of irony. In 2010 the Bush family, along with Rove and Karen Hughes, undertook an unprecedented effort to kick him out of the governor’s chair, handing a crowbar to Texas Sen. Kay Bailey Hutchison, whom they judged more “electable.” Perry walloped her in the GOP primary, then went on to win a historic third term in the general election by a double-digit margin. So much for electability.
A Perry victory would end whatever chokehold the Bushes still have on the GOP establishment.
But Rove is nothing if not persistent. Now he and his operatives seem to have something close to a war room against Perry, scrutinizing his every statement in an attempt to cut his young candidacy short. After Rove called Perry “unpresidential,” former Bush press secretary Tony “Ralph Malph” Fratto joined in—calling Perry, you guessed it, “unpresidential.” This was followed in quick succession by similar sentiments from a former Rove aide, Pete “Potsie” Wehner. Meanwhile, two “unnamed” Bush aides (wonder who they could be?) issued the following warning to The New York Times: “If you’re really trying to be the nominee and want to go the distance, you just don’t want the former president of the United States and his people working against you.” (Then again, that’s what the Bushes told Kay Bailey Hutchison.)

Senate Confirms Federal Judges For New Mexico, Texas, North Carolina, Florida

The U.S. Senate has confirmed the appointments of five new federal judges.
Late Thursday, senators approved the nominations of Frank Montalvo and Xavier Rodriguez to federal judgeships in Texas, and of James I. Cohn, James O. Browning, and H. Brent McKnight to seats in Florida, New Mexico, and North Carolina respectively.
Montalvo and Rodriguez were confirmed to judgeships for the Western District of Texas. Sens. Kay Bailey Hutchison and John Cornyn, both R-Texas, recommended the two to President Bush.
Montalvo was nominated for a new seat in the Western District, and is expected to sit in El Paso. Rodriguez was nominated to fill the vacancy left when Judge Edward Prado was named to the Fifth U.S. Circuit Court of Appeals and is likely to sit in San Antonio.
Montalvo was confirmed on a 95-0 vote and Rodriguez was approved on a voice vote.
“Frank Montalvo and Xavier Rodriguez will only add to the exceptional tradition of judicial excellence the Western District has long enjoyed,” Cornyn said Thursday night in a statement from Washington.
“Judge Montalvo possesses a wealth of judicial and legal experience. He represents some of the finest qualities we expect in our federal judges,” Hutchison said Thursday night, also in a statement from the nation’s capital.
“Judge Rodriguez brings the qualifications and integrity to the bench that Texas and our nation need now,” Hutchison said.

Not once do they mention Perry. If Perry was such a supporter wouldn’t the Bush operatives want to mention that?
