The case is headed to a grand jury but this guy’s more likely to land on Barbara Walters’s couch than in prison. I’d be surprised if there’s a GJ in America that would indict him; if there is, lord knows it’s not in Texas. Here’s the relevant statute in the state’s penal code. Not a close call:

Sounds like self-defense as he was protecting/defending his daughter who was being attacked by a pedophile pervert. Obviously she was unable to defend herself and her father stepped in and did what was right in defending her.

I agree with you, HG. Not 100% sure what the exact charge would be (murder 2 or manslaughter) but I do believe a LOT of states wouldn’t use common sense with this. I think they would definitely charge and let the jury decide (hurting the little girl even more). I am glad Texas has common sense.

Take away the “emotion factor”, this is totally justifiable. A capital offense was occurring. This was a good shoot..

He’s charged with homicide. The grand jury will not indict him. So, I suppose it would become justifiable homicide?
Even if it had not been his own child, a good beating causing death to that pervert was correct.
“Aggravated” generally means the actor was using deadly force. If the perpetrator was using deadly force against this guy’s daughter, then absent any intervening circumstances, yes, it is probably justifiable homicide according to the statue.

There is no way any grand jury here would indict a guy for killing a man in the act of molesting his daughter.
There's some stupid laws around here, but that's just silly.
