Chief justice stresses need for judges, funds despite US fiscal strain

Chief Justice John Roberts on Monday called on the White House and Congress to provide sufficient funding and enough judges to ensure that the federal judiciary can do its job well despite the fiscal problems the country faces.

In his annual report on the federal judiciary, Roberts recognized the battle in Washington over the “fiscal cliff,” saying the country has a fiscal ledger that has “gone awry” and must address the longer-term problem of a “truly extravagant and burgeoning national debt.”

He said the judiciary has been doing its part to cut costs aggressively, but can only go so far given that it cannot choose its caseload or economize much further without reducing the quality of its services. …

I have to say I do prefer Newsmax’s title of the same article: Roberts Pleads for Courts to Be Spared From Cuts

Much more accurate. Also, a bit hypocritical on Roberts’ part to be the big beggar in all of this after his ruling on Obamacare, perhaps . . . ?

Cutting costs? You’re worried about cutting costs, Roberts? Why didn’t you make a Constitutionally based ruling on ObamaCare?? We could have saved a HELL of lot of tax dollars if you hadn’t twisted yourself into a pretzel in order to find ObamaCare Constitutional!
Don’t lecture anybody on what should be done on ANY topic, Roberts. Phonies, liars, hypocrites and clowns like you should remain very quiet and stand WAY in the background any time honest people choose to have a discussion.

Justice Roberts had a chance to make a Constitutional ruling on 0-Care. However, the present Supreme Court will be looked back on with fondness if/when Obama gets to appoint a few more Justices

What Roberts didn’t say was that he is also head of the “Judicial Conference of the United States”.

Five standing Advisory Committees of the Judicial Conference have been established, and are charged, respectively, with drafting proposed amendments to the:

Federal Rules of Civil Procedure;
Federal Rules of Criminal Procedure;
Federal Rules of Bankruptcy Procedure;
Federal Rules of Appellate Procedure; and
Federal Rules of Evidence.

Members of the Advisory Committees include judges, representatives from the Department of Justice, law professors, and practicing attorneys. The Advisory Committees propose rules, subject them to public comment, and then submit them to the Standing Committee on Rules of Practice and Procedure, which in turn submits them to the Judicial Conference, which recommends them to the Supreme Court for approval.

While it seems that this is a “trickle up” organization, in truth the Supreme Court justices can pretty well demand significant changes to the federal judicial processes.

As such, Roberts could significantly streamline the federal judicial process, reducing the time and expense of federal court cases by half or more.

For instance, one federal civil case, Knapik v. Penn Central, has been in federal court now for 43 YEARS! It is not unreasonable for the public to demand an immediate resolution of many federal court cases in a reasonable length of time.

Heaven knows how much taxpayer money has been squandered on such cases, and yet Roberts has the chutzpah to demand such funding continue.

No! Fix the process first.
