In 2008, Julius Genachowski served as candidate Barack Obama’s Chairperson of the Technology. Upon winning the Presidency, Obama thanked the lawyer by appointing him to serve as Chairman of the nation’s Federal Communications Commission.

In September 2012, Genachowski instructed Commission staff to begin reviewing the Commission’s broadcast indecency policies and enforcement, arguing that present day indecency laws may not be in step with “First Amendment principles.”.....

I was wondering how nudity could be non sexual and then you gave three examples in the same post. Just DAMN! they would make my eyes bleed and me impotent, non sexual indeed!

To begin with, the Founding States made the first numbered clauses in the Constitution, evidently a good place to hide them from Obama, Sections 1-3 of Article I, to clarify that all federal legislative powers are vested in the elected members of Congress, not in unelected bureaucrats in constitutionally undefined federal agencies like the FCC. So no bureaucrat in so-called "independent federal regulatory agencies" like the FCC can regulate speech, even to declare that there are no regulations.

And speaking of regulating speech, Thomas Jefferson had noted that the Founding States had made the 10th Amendment to clarify that the states had reserved government power to regulate our constitutional rights, even those protected by the 1st Amendment, uniquely to the states, power now limited by the 14th Amendment, regardless that the Founding States had also made the 1st Amendment to clarify that such powers are prohibited to Congress entirely.

"3. Resolved that it is true as a general principle and is also expressly declared by one of the amendments to the constitution that ‘the powers not delegated to the US. by the constitution, nor prohibited by it to the states, are reserved to the states respectively or to the people’: and that no power over the freedom of religion, freedom of speech, or freedom of the press being delegated to the US. by the constitution, nor prohibited by it to the states, all lawful powers respecting the same did of right remain, & were reserved, to the states or the people: that thus was manifested their determination to retain to themselves the right of judging how far the licentiousness of speech and of the press may be abridged without lessening their useful freedom, and how far those abuses which cannot be separated from their use should be tolerated rather than the use be destroyed (emphasis added); …" --Thomas Jefferson, Kentucky Resolutions, 1798.

So as Jefferson indicated, it's basically up to the individual states, not Congress or any rogue agency of the corrupt federal government, to reasonably decide how far laws to limit speech can go.
