There is ONE THING and ONE THING ONLY that Republicans in the Congress MUST do this spring. And that is to make a very reasonable legislative change to the “Affordable” Care Act (AKA Obamacare). That legislative change would consist of two elements:

1. REQUIRE that the insurance companies participating in the “Affordable” Care Act (ACA), for each of their ACA health insurance policies, release their 2015 policy terms (monthly premium, yearly deductible, annual out-of-pocket maximum, coinsurance percentage and copay amount) to the public not later than October 1, 2014. They also should be required to mail the new 2015 terms to their existing ACA policy holders by September 15th so their policy holders receive it by October 1st.

2. Limit the “Risk Adjustment Payments” for 2015 to no more than 50% (lower would be better) of the losses that the insurance company suffers for 2015. That would help insure that insurance companies have more “skin in the game” when they are deciding upon their 2015 policy terms and thus more likely to set realistic rates. It would also help increase their resistance to threats and “jawboning” from Obama’s thug operatives.

Since participating insurance companies are required to notify the federal government of their 2015 rates in the April/May 2014 time frame, the public notification provision would certainly not be unreasonable or an undue burden for the insurance companies.

This modest and reasonable legislative change SHOULD be included in any legislation increasing the Debt Limit or in any other legislative bill to which it could be attached.

Will John Boehner and Mitch McConnell have the guts and foresight to actually do this? Unfortunately, they likely will lack both the guts and the foresight to do this. If this were done it would be certain that there would be a massive conservative tide coming out of the 2014 elections.
