Today, an Arizona state senate committee approved a bill that would virtually nullify all federal gun acts, laws, orders, rules or regulations. The vote was 6-3.
Along with twelve sponsors and co-sponsors, Arizona State Sen. Kelli Ward introduced the Second Amendment Preservation Act in the Grand Canyon State. SB1294 prohibits the state from enforcing “any federal act, law, order, rule or regulation that relates to a personal firearm, firearm accessory or ammunition within the limits of this state.”
“We’ve sat back and allowed the federal government to trample the Constitution long enough,” Ward said. “We’re going to pass this bill and stop the state of Arizona from helping the feds violate your rights.”Fox News Senior Judicial Analyst Judge Andrew Napolitano said that a single state refusing to enforce federal gun laws would make them “nearly impossible to enforce.” Napolitano praised Arizona's effort in the current session.

What bothers me is this - it isn’t agents of the State of Arizona who come into our local gun store to make sure Federal laws are being enforced. It’s the BATFE. So, how does this law keep that from happening? And if it doesn’t, what good is it?
I don't know if it is this bill, but ones I have seen make it a state crime for federal agents to attempt to enforce such laws, and subjects them to arrest and imprisonment by local authorities.
Wish more of the red States would get on board.

No, it does not do that. It may not stop BATFE from enforcing the rules for Federal Firearms Licenses. But to withdraw local support from the federal government on these issues means a great deal.

SB1294 passed the Senate Judiciary Committee, but still needs to be debated in the Senate Rules Committee. The text of the bill indicates that it only penalizes state agents/agencies if they try to uphold Federal laws that the bill declares to be invalid.

Kansas' law declares that the federal government has no authority to regulate guns, ammunition and accessories manufactured, sold and kept only in Kansas. The law also makes it a felony for a federal agent to enforce any law, regulation, order or treaty covering those items.
This would mean that a gun manufactured, sold and kept in Kansas wouldn't require a Federal background check which means the Feds wouldn't have access to the type and serial number.
There’s a similar law in the Florida House (HB 733) right now. This is a nationwide initiative, from what I’ve heard.

That could also mean that any agent committing a felony of the sort could be dealt with using the same level of resistance. The victim should be exonerated from using deadly force.

I agree with you that not allowing local/state “troops” to join the feds is a great and good thing. Penalizing the feds would be even better.
Interesting idea, but couldn’t the Feds just send their own armed troops in to bring a rebellious state back into line? They pretty much did this in the 1860s last time a few states starting getting uppity and thinking they were above the Federal Government...
