IRS Stonewalling FOIA Request Surrounding Correspondence With Democratic Members of Congress

On May 21, 2013 the National Republican Senatorial Committee sent the IRS a Freedom of Information Act request asking for "any and all documents or records, including but not limited to electronic documents, e-mails, paper documents, photographs (electronic or hard copy), or audio files," related to correspondence from January 1, 2009 and May 21, 2013 between thirteen different Democrat members of Congress and top IRS officials. Those officials include former IRS Commissioner Doug Shulman, former Commissioner Steven Miller, senior IRS official Joseph Grant and former head of tax exempt groups Lois Lerner. Members of Congress named in the request include Sen. Schumer (D-NY), Sen. Reid (D-NV), DSCC Chair Sen. Bennet (D-CO), Sen. Landrieu (D-LA), Sen. Pryor (D-AR), Sen. Hagan (D-NC), Sen. Begich (D-AK), Sen. Shaheen (D-NH), Sen. Mark Udall (D-CO), Sen. Franken (D-MN), Sen. Warner (D-VA), Rep. Braley and Rep. Peters (D-MI).

Since that request was received by the IRS nearly one year ago, IRS Tax Law Specialists Robert Thomas and Denise Higley have asked for more time to fulfill the request six times.

Senate Democrats facing tough elections this year want the IRS to play a more aggressive role in regulating outside groups expected to spend millions of dollars on their races. In the wake of the IRS targeting scandal, the Democrats are publicly prodding the agency instead of lobbying them directly.

Dems are also careful to say the IRS should treat conservative and liberal groups equally, but they’re concerned about an impending tidal wave of attack ads funded by GOP-allied organizations. Much of the funding for those groups is secret, in contrast to the donations lawmakers collect, which must be reported publicly.

One of the most powerful groups is Americans for Prosperity, funded by the billionaire industrialists Charles and David Koch. It has already spent close to $30 million on ads attacking Democrats this election cycle. “If they’re claiming the tax relief, the tax benefit to be a nonprofit for social relief or social justice, then that’s what they should be doing,” said Sen. Mark Begich (D), who faces a competitive race in Alaska. “If it’s to give them cover so they can do political activity, that’s abusing the tax code. And either side."

<><><><>Asked if the IRS should play a more active role policing political advocacy by groups that claim to be focused on social welfare, Sen. Jeanne Shaheen (D-N.H.) responded, “Absolutely. Both on the left and the right,” she said. “As taxpayers, we should not be providing a write-off to groups to do political activity, and that’s exactly what we’re doing.”

Shaheen called the glut of political spending by self-described social welfare groups that qualify under section 501(c) (4) of the tax code “outrageous.” Shaheen is in a good position now but could find herself embroiled in a tight campaign if former Sen. Scott Brown (R-Mass) challenges her.<><><><>

Sen. Mark Pryor (Ark.), the most vulnerable Democratic incumbent, said the IRS has jurisdiction over 501(c)(4) groups, as well as charities, which fall under section 5/01(c)(3) of the tax code and sometimes engage in quasi-political activity.

“That whole 501(c)(3), 501(c)(4) [issue], those are IRS numbers. It is inherently an internal revenue matter,” he said. “There are two things you don’t want in political money, in the fundraising world and expenditure world. You don’t want secret money, and you don’t want unlimited money, and that’s what we have now.” --SNIP--

AS Sec. of the US Treasury, Geithner would have had administrative control of the IRS, and all of its employees, including current scapegoat Lois Lerner.

Geithner would have had to have known of any IRS Program to silence those who opposed the Obama administration that Geithner was a key part of, because the IRS was then the main profit center for the always in debt US Treasury Department.

Hence, anything that might have a a negative effect on the income stream to the IRS, such as protests against the IRS by “dangerous,” (Lerner’s word), anti-Socialist Groups would be considered to be a direct threat by shifty-eyed Geithner, liar Obama and lawless Holder.

The above is speculation, but probable, and thus worthy of Investigation by a House Special Prosecutor or Committee, IMHO, of course.

You are closer to the truth on this subject than anyone has ever come.

The malevolent parasitic strain of Chicago criminals wasted no time.....they had a stranglehold on the US Treasury from the getgo. The minute Obama/Valerie/Rahm/Axelrod/Geithner, and that diseased bunch, landed in DC they did two things that were apparently crucial to their evil plans

(a) they took control of the US Census;

(b) Obama placed his COS Rahm Emanuel in control of the US Dept of the Treasury (the IRS).

THE SMOKING GUN---WSJ REPORT--On Jan 20, 2009 Timothy Geithner was appointed Obama's Secy of the Treasury. But within three weeks, the Obama White House tightened its grip on Treasury. Obama put his COS, Rahm Emanuel, in charge of Treasury---Rahm Emanuel's dual role was an unusual move.

When he got to Treasury, WH COS Rahm Emanuel was so involved in the inner workings of the Treasury that the phrase "Rahm wants it" had become an unofficial mantra among subservient govt staffers, prostrate in obeisance, scurrying to accede to Rahm's wishes, according to Treasury government officials. What a hideous article. The National Republican Senatorial Committee is a quasi political organization and has no business getting affirmative FOI responses vis-a-vis opposition party emails and work product just on a whim. Every Tom, Dick and Harry would be FOI’ing every candidate and incumbent.

And it’s a stupid move making it so prominently a public issue. It steals the thunder and will caste a partisan cloud over the heads of GOP select committee members looking for the very same documents for official reasons.

-1 for Katie Pavlich and the NRSC for playing right into the Liberals strength — making political over stupid things the GOP does.

Obama came to 'oversee' the tornado damage in Arkansas and Pryor met him there.

Neither has ever worked a day in his life!

Photo op, pure and simple, nothing else. As if them being there is going to change anything or help anyone! And notice too, there is NO ONE there to 'greet' them. Can't imagine why.

As The Washington Post notes, Pryor "likes to cast himself to voters as an independent senator on Capitol Hill" during his campaign in Arkansas.
