Obama’s Law School Professor: EPA Is ‘Burning The Constitution’
The Daily Caller News ^ | 03/17/2015 | Michael Bastasch

resident Obama has found himself at odds with his old law school mentor over the Environmental Protection Agency.

Laurence Tribe, a liberal constitutional scholar at Harvard University, told House lawmakers that EPA carbon dioxide regulations are tearing the Constitution apart.

“EPA possesses only the authority granted to it by Congress,” Tribe told lawmakers in a hearing Tuesday. “Its gambit here raises serious questions under the separation of powers… because EPA is attempting to exercise lawmaking power that belongs to Congress and judicial power that belongs to the federal courts.”

“Burning the Constitution should not become part of our national energy policy,” Tribe added.

Tribe, along with other legal and energy experts, appeared before Congress Tuesday to give testimony on the EPA’s “Clean Power Plan” — the agency’s plan to cut carbon dioxide emissions from new and existing power plants. Tribe told lawmakers the CPP is unconstitutional and outside the agency’s authority.

EPA is attempting an unconstitutional trifecta: usurping the prerogatives of the States, Congress and the Federal Courts all at once,” Tribe told lawmakers.

This is not the first time Tribe criticized the EPA’s power plant rules.

Why is Tribe the one pointing that out? Cat got Boehner's tongue?

How 'bout defunding The EPA?

What am I saying? I actually expect Republicans to protect and defend The Constitution?

The EPA is only trying to get more monopoly money for some water heater, wood heater and natural gas interests (gas-fired power plants).

So, this being the case— Congress leadership should shut down and defund the operations and actions of EPA that violate the Constitution— on the basis of Constitutional powers of Congress superseding any agency “regulation”.
And, businesses should ignore EPA, having the backing of the American People.

Ha...the Obama regime lies about everything...including global warming...

What do you think is going to be the US population survival rate when global cooling kicks in....and with all those coal and nuclear power plants shut off....

you going to rely on snow and ice covered solar cells....or frozen windmills...

Fits in with Bill Ayers prediction that 23 million need to be extinguished.

Global Warming is the excuse the Liberals are using so that they can tax the air we breathe.

We used to joke about air being the only thing that the government can’t tax, but then we never appreciated the lengths to which liberals will go to tax everything that moves.

Since the air moves, it must be taxed.

"you going to rely on snow and ice covered solar cells..."

Well, yeah, but I don't have another choice here, away from what so many folks call civilization. ;-)

Really the little PV solar plant works well, even though winter temps usually go down into the minus-30s here. Heating, though, is an ongoing challenge. Working on a solar heating system (collectors, tanks and the like) and a homebuilt heater with much mass that will use very little wood.

Big corporate and local government interests shouldn't be indulging in sweetheart suits and schemes with the EPA to shut down competition (like coal--nothing wrong with coal). It costs consumers and the economy in general too much. Natural gas, wood stove and water heater interests should struggle against competition like everyone else. Government shouldn't exist to serve monopolists and useless regulators.

Now, now. That's not true.

They are only taxing the air you breathe OUT - The air you breathe in is still tax-free.
In CA, the water you drink is taxed though! Except for that run out of the dams to let an imported fish continue to breed.

I don’t understand why Congress doesn’t reign in these rogue agencies.

The simplest explanation is that it is because the Congress agrees with these agencies and their regulations.
A great example is when the NSA was revealed to be engaging in domestic espionage on us, the citizens, the congress basically wrung their hands saying how awful or justifying it (because we gotta catch those terrorists) but not actually doing anything about it. (The IRS, EPA, BATFE, DOJ, etc are all the same.) — In short, it allows them to avoid accountability by whining and crying that it's the executive branch.

Temps were 30 to 50 degrees Fahrenheit above average for the winter here (high spot on the Rockies), but I was in a weird weather spot, probably for this last winter only. Temps usually go into the minus-30s and may well do that or worse next winter. Wind gusts go over 100 sometimes in this little spot. Seeing some unusual fluctuations and not as many windy periods this year (so far).

It’s not man-caused global warming, of course. What we’re seeing is uncommon for us but perfectly natural. You probably already know about the general decrease in sun activity as part of the extended solar minimum. Nothing we can do to change that.

Magnetic north is also on the move because of outer core and mantle activity—only happens once in a great while. As that happens, the field weakens in spots. Unusual weather patterns form for a time.

There’s nothing we can do to change it. We accept it, adapt and move on. Meanwhile, political groups grasp at anything to disseminate their maniacal messages and try to grab more socialist funding from other political groups.

OUT OF CONTROL executive branch ALERT!

DEFUND/DISMANTLE the EPA

He has erected a multitude of New Offices, and sent hither swarms of Officers to harrass our people, and eat out their substance.

http://en.wikipedia.org/wiki/Cabinet_of_the_United_States

http://www.epa.gov

In an unrelated, but contemporary, event, Congress established the Environmental Protection Agency (EPA) in 1970, at what may have been the dawn of the Watergate Era. According to the EPA website, the agency’s very first budget in Fiscal Year (FY) 1970 was just over $1 billion. In the ensuing years, the agency’s budget grew steadily until it exceeded $10 billion in FY 2010. That amounts to an average annual increase of about $225 million over 40 years. That growth in the EPA budget includes a very large increase from FY 2009 to FY 2010 of $2.65 billion, a one year increase of more than 10 times the annual average increase over 40 years, and about 35% over the FY 2009 budget.

http://www.koleyjessen.com/resources/following-the-money-a-quick-look-at-the-epa-budget/

ENVIRONMENTAL PROTECTION AGENCY:
The agency gets $8.1 billion, down $60 million from the last fiscal year. The agency’s budget has been slashed by $2.2 billion, or 21 percent, since fiscal 2010, according to GOP aides. The cuts mean that EPA will have to reduce its staffing to the lowest levels since 1989.

http://www.washingtonpost.com/blogs/post-politics/wp/2014/12/09/whats-in-the-spending-bill-we-skim-it-so-you-dont-have-to/

More cuts. Reduce staff and budget until eliminated.
