Supreme Court Caves on Obamacare Again
American Spectator ^ | 6/25/2015 | David Catron

The Supreme Court had an opportunity, with its ruling in King v. Burwell, to determine whether the United States is a nation of laws or of men. Today, in a 6-3 decision, the Court ruled that we have devolved into the latter.

Although the text of the Patient Protection and Affordable Care Act (a.k.a. Obamacare) clearly states that the government may issue subsidies only through insurance exchanges established by the states, Obama administration bureaucrats unilaterally rewrote that part of the law so that the IRS could dispense such premium assistance through “marketplaces” created by the federal government. The plaintiffs in King sued the government on the grounds that the Executive Branch has no power to thus alter an act of Congress.

Incredibly, SCOTUS has sided with the White House.

Correct me if I’m wrong, but wasn’t this supposed to be the time we we’re going to praise Justice Roberts for deftly handling the ACA situation by calling it a ‘tax’?

Today was the day we were going to sing his praises for being so smart...much smarter than all of us who said this whole thing was unconstitutional.

Not to mention the unconstitutionally un-American way it was passed.

I was not surprised. Our courts seem to be trending downward these days, away from sensible business practices and individual rights.

If the government doesn’t have to follow its own rules, why do any of us?

The only avenue left to us to save the Republic is an Article 5 Convention.

From the Opinion of the Court:

At the outset, it might seem that a Federal Exchange cannot fulfill this requirement. After all, the Act defines “State” to mean “each of the 50 States and the District of Columbia”—a definition that does not include the Federal Government. 42 U. S. C. §18024(d). But when read in context, “with a view to [its] place in the overall statutory scheme,” the meaning of the phrase“ established by the State” is not so clear.

So Roberts claims that a clearly written statutory provision can be converted to being ambiguous by reading that provision "in context". What is that context? I'm guessing the Liberal Messiah knows and Roberts wants it kept a secret.

Amen! All the fear mongering that’s been done regarding such a convention is already a reality within every branch of the federal government. We have nothing to lose.

That is the only peaceful recourse WE THE PEOPLE and the 50 states have left. After all, we’re in the same boat as the several states (the Red colored ones anyway).

There is another way, and we are lawfully allowed to use it under the supreme law of the land...The Declaration of Independence.

What is left to fear when the Executive does as it likes and the so called loyal opposition is more loyal to the Executive than it is in opposition.

I have lost all respect for Speaker Boehner and the Republicans in Congress with but a few exceptions.

It is up to the states to force compliance with the Constitution. It is the states or armed revolution.

SCOTUS didn’t cave.

SCOTUS approves of the 0ligopoly controlling everything, no matter what the law says.

It is far worse than just the atrocity of Obamacare. It is about THE CONSTITUTION and the obviously overt attempt to destroy it. The SCOTUS just broke the law, in order to allow continued breaking of the law.

A Constitutional crime and a DANGEROUS precedent, second time around.

Yes, but that has never been attempted in this country either.

And considering that over the last few decades most of the officer corps in this country has been packed with Leftist I don’t hold out much hope for a coup. .

Armed revolution would be a bloody carnage much like the Civil War unless the rank and file of the military sided with the civilian militia which is a long shot at best.

Article 5 is the last best hope for the last best hope.

We should all listen to Mark Levin tonight and see what he has to say about this farce that the USSC has handed down to We the People Peons.
