Former US attorney: Clinton aides' legal strategy is 'red flag'

Four central figures in the FBI’s criminal investigation of Hillary Clinton’s email practices are all using the same lawyer, a move described as a “red flag” by a former U.S. attorney who now runs a government watchdog group.

Lawyer Beth Wilkinson is representing: Clinton former chief of staff Cheryl Mills; policy adviser Jake Sullivan; media gatekeeper Philippe Reines; and former aide Heather Samuelson, who helped decide which Clinton emails were destroyed before turning over the remaining 30,000 records to the State Department.

"I think it would be a real red flag," Matthew Whitaker, executive director of the Foundation for Accountability and Civic Trust, or FACT, told Fox News, in reference to the legal defense. He suggested having a single lawyer would help the four Clinton aides align their stories for FBI interviews.

"The benefit is to have one lawyer’s brain have all the knowledge of the various pieces and parts, and so each of those potential targets or subjects of the investigation get to share information across that same attorney -- and quite frankly get their story to sync up and understand what other people know of the situation,” he said.

Wilkinson is a well-respected Washington, D.C., attorney who successfully argued in favor of the death penalty for Timothy McVeigh in the Oklahoma City bombing case. Wilkinson has deep ties in Washington and is married to former NBC “Meet the Press” host David Gregory, who is now a regular political commentator on CNN.

Want more red flags, how about Cheryl Mills' memory failing over 150 times during her deposition or Pagliano pleading the 5th at same?

At all levels of judicial authority, we've seen prosecutors and judges running in fear. WHEN IS SOMEONE GONNA DROP THE HAMMER ON THESE CRIMINALS.. FOR ONCE?

Judge Hanen talked tough, but NOTHING.
Judge Sullivan talks tough, but ______ (NOTHING, probably)

No one wants to get Foster'd, Stevens'd, Scalia'd, Kyle'd. When will a martyr for the U.S. Constitution FINALLY face up to these criminals?

And people wonder why Trump is so popular!

If they all have the same lawyer, that lawyer could play favorites and set one of them up to take the fall.

Not real smart thinking there.

Yeah, I had the same thought when I first heard this. Downside is if one cracks, then you have a real conflict of interest situation which might disqualify you from representing any after that.

it is typically done when a group of people all worked together, got caught together, and have something to hide together.

(2) Court’s Responsibilities in Cases of Joint Representation. The court must promptly inquire about the propriety of joint representation and must personally advise each defendant of the right to the effective assistance of counsel, including separate representation. Unless there is good cause to believe that no conflict of interest is likely to arise, the court must take appropriate measures to protect each defendant’s right to counsel.

Sounds like on old-timey dual agency divorce or tornado—someone’s losin’ their trailer.

Definitely not illegal, however it becomes an issue if an indictment is issued and the four people become defendants. The government could file a motion to disqualify the attorney and it would likely be granted. There's a huge conflict of interest attempting to represent multiple co-defendants in the same case. The thing to remember is there are no defendants yet, technically, so it's not an issue as of yet, but will become one if charges are filed. That pretty much sums it up.
