Former Va. first lady Maureen McDonnell’s corruption case on hold

A federal appeals court has signaled that it agrees that former Virginia first lady Maureen McDonnell’s corruption convictions should be tossed out because of the U.S. Supreme Court decision that overturned her husband’s convictions.

Attorneys on both sides said that a ruling Friday by the U.S. Court of Appeals for the 4th Circuit suspends the public corruption case, and that further legal action is necessary to vacate the convictions as prosecutors decide whether to seek a new trial. But they said the order indicates that the court agrees with a defense analysis — unchallenged by prosecutors — that the first lady’s convictions cannot stand.

“Although the United States acknowledges that the Supreme Court’s opinion in McDonnell v. United States is equally applicable to Maureen McDonnell’s convictions, Mrs. McDonnell’s convictions have not been vacated,” federal prosecutors in Virginia said in a statement.

“At this time we are thoughtfully determining next steps in both cases,” prosecutors said in the statement.

The McDonnells were accused of helping a dietary supplement salesman in exchange for more than $175,000 in gifts and personal loans. They were tried together and convicted in 2014, although they had different defense teams and their appeals have proceeded separately.

The high court in June overturned Robert F. McDonnell’s convictions, but his wife’s case has remained under appeal.

“Her case has always been the follow-on case; this has always been all about the governor,” said Scott Fredericksen, a public corruption expert at the firm Foley Lardner. “What happens with his case will happen with her case.”

I talked with Bob on at least 3 occasions. Rather liked the man. I was sad to see the screw-up.

I’m all about convicting people guilty of corruption but the system is itself corrupt. That became self-evident when Tom Delay was railroaded and the gutless Republican “leadership” did nothing for the guy. They let him burn to avoid a little bad press, talk about gutless.

It’s ironic that James Trafficant can go to federal prison for 8 years, 7-1/2 of it in solitary confinement, and he died shortly after serving his sentence but Hillary and Pelosi walk again and again and again for blatant contracting fraud. Trafficant must’ve really pissed off somebody on the DNC side.

that was a good read, I still recall his mess in congress under GWB term..just wondered if he returned to active Politics..
Ya know, once a Professional Politician, that is all they ever usually are...

Really disgusted with the Republican Party as a whole right now...Never have I lived thorough such hateful action to a nominee for POTUS. and I'm old, been around along time..

I hardly think you are the Lone ranger on that. I too am disgusted with them. Ever since we gave them a majority in both the Houses & Senate and they still did nothing to thwart Obama and his policies. Instead giving him more than what he asked for. If it were not for Trump I would probably be sitting this election out, or voting for the stoner running as the Libertarian. I still want to eliminate every last RINO and replace the GOPe.

While Trump may have endorsed Ryan & McCain, I support neither and want them replaced by their primary challengers. Time for them to go home and live under the stupidity they have allowed, like we common folk have to do.
