Don’t indict her until after Trump is sworn in.
I think the back-up plan, if Trump loses, is that they’d lay out evidence on the table and try to impeach President Hillary by the end of 2017. Just with the Clinton Foundation business....there is enough there.
Don’t forget that as a lame duck, regardless of who wins, Obama will be handing out plenty of pardons. If he doesn’t pardon her and she is elected, once inaugurated, impeachment is the only avenue, she cannot be indicted in a normal criminal process. If she were elected, and indicted but not pardoned by Obama, she can take the oath while under indictment, and even pardon herself. Even if she loses and is not indicted, Obama can preemptively pardon her, as Ford did Nixon. So, she has a number of ways to skate.
