In Defiance of Federal Order, NYC Allows Known MS-13 Gang Member to Walk Free from Rikers

In a stunning idiotic display of defiance against the federal immigration laws, the city of New York has released a known member of the violent street gang ‘Mara Salvatrucha’ (MS-13), placing innocent citizens at risk instead of simply complying with a ICE petition to hold the prisoner for deportation.

The head scratching decision to Estivan Rafael Marques Velasquez left many across the country enraged and comes as part of NYC Mayor Bill de Blasio’s ‘Sanctuary City‘ law which promises safe harbor to those that have entered the United States illegally.

According to reports, Velasquez was serving time at the Rikers Island correctional facility for a disorderly conduct charge and despite a standing deportation order from a federal immigration judge, authorities allowed the self-professed gang member to walk instead of turning him over to ICE officials.

Speaking on the matter of Velasquez’s release, Thomas Decker, the US Immigration and Customs Enforcement field office director for New York stated “This man is by his own admission a member of a violent street gang and he was released back into the community… Honoring a detainer request is not about politics, it is about keeping New York citizens safe.”

So how exactly did this happen?

Well, because under de Blasio’s 2014 sanctuary city law, Velasquez does not qualify as a serious or violent offender and due to this, NYC refuses to notify federal agencies about the release of illegal immigrants convicted of ‘minor crimes.’

“The detainee was released after he pled guilty and served his time to an offense that does not qualify as a violent or serious felony under the city’s local laws‎, and his gang affiliation was not supported by evidence that meets even minimal constitutional standards,” City Hall spokesperson Rosemary Boeglin said.

“When ICE presents evidence to our city that an individual in our custody has been convicted of a violent or serious offense — one that threatens the public’s safety — we will fully cooperate.”

So what sorts of ‘minor crimes’ has this 19-year-old been charged with in the past? According to federal officials, second-degree reckless endangerment, fourth-degree criminal possession of a weapon and disorderly conduct, just to name a few.

But have no fear, according to a press release from the Immigration and Customs Enforcement, agents were able to apprehend Velasquez despite NYC’s uncooperative nature and he is still set for deportation.

NEW YORK — Officers with U.S. Immigration and Customs Enforcement’s (ICE) Enforcement and Removal Operations (ERO) arrested a self-admitted MS-13 gang member Feb. 16 after he was released from New York City custody with an active ICE detainer in place. The Salvadoran national has a criminal history in the U.S. which includes reckless endangerment in the second degree, criminal possession of a weapon in the fourth degree, and disorderly conduct.

Estivan Rafael Marques Velasquez was released from local custody Feb. 16, after serving time for a criminal conviction of disorderly conduct. ICE filed the detainer May 3, 2016 with the Rikers Island Correctional facility where he was released with disregard for the active detainer. Marques entered the United States without being inspected by an immigration officer. On July 28, 2014, he was issued a Notice to Appear. In Nov. 2015, Marques was ordered removed by an immigration judge.

ERO officers arrested Marques Velasquez Feb. 16 in Queens, New York, pursuant to a final order of removal. He has been processed and is now in ERO detention pending removal.

“This man is by his own admission a member of a violent street gang and he was released back into the community. Honoring a detainer request is not about politics, it is about keeping New York citizens safe,” said Thomas R. Decker, field office director for ERO New York. “ICE continues to welcome changes to the city’s current policy which is creating a potentially unsafe environment for its residents. ICE remains steadfast in solidifying its relationship with local law enforcement in the interest of public safety and national security.”

In fiscal year (FY) 2016, ICE removed or returned 240,255 individuals. Of this total, 174,923 were apprehended while, or shortly after, attempting to illegally enter the United States. The remaining 65,332 were apprehended in the interior of the United States, and the vast majority were convicted criminals.

DeBlasio and his boys should be charged with every person this gangstah murders and every crime he commits. This crap has got to stop.

I have asked this before, but why are these people not being charged with aiding and abetting?

This in violation of the law, and if it is good for them , then why not the states now ignore their sham of a marriage for homosexuals?

If it’s a federal court order, can’t someone be held in contempt!

I’d lock up the officers who released him and anyone who gave them orders to ignore the federal court order on contempt charges.

If this isn’t contempt, I don’t know what is.
