RED BLUFF, Calif. — A farmer faces trial in federal court this summer and a $2.8 million fine for failing to get a permit to plow his field and plant wheat in Tehama County.

“The case is the first time that we’re aware of that says you need to get a (U.S. Army Corps of Engineers) permit to plow to grow crops,” said Anthony Francois, a lawyer for the Pacific Legal Foundation. The libertarian-leaning nonprofit fights for private property rights and limited government.

Go check the production history on the property.

The property has been tilled in the past. It’s in the USDA records at the county and state level.

It is the object of the UN and the est of thee Globalists that private property tights are obliterated. If we do not fight for them we will lose them. Unfortunately, there are far too many people who don’t give a damn until it happens to them. Pacific Legal is doing an outstanding job. Support them instead of throwing up your hands in defeat.

Thanks for the research. It seems that he may have tilled the soil a few inches deeper than allowed. God help us with future food production.

From a farming family originally, and I still have nostalgia for the soil and animals. It’s in the blood;)

Perhaps the levels and ways that a “property owner” can be oppressed vary and can be fought or disputed, but until the day that property taxes and estate taxes are abolished, deeds are just rental contracts and nothing more.

The property is an old wheat field that had been allowed to go fallow, during the years when commodity prices were in the tank.

No point is growing grain when the market conditions preclude making a profit.

There are aerial photos and crop records indicating the property has been farmed. Mr. Duarte is being railroaded.

The term "waters of the United States" should be limited to navigable waters that can actually be used in interstate or foreign commerce. Trump should redefine them as such while awaiting passage of a bill by Congress cements this into law. The idea that anything that affects interstate commerce is a power grab by the Fed's.

He is being prosecuted by the US Attorney, by Jeff Sessions or Jeff’s assistant... Assistant US Attorney for that part of Californika. He is not being persecuted by California in this Federal Court.
