WASHINGTON The Supreme Court on Monday reaffirmed its 2015 decision recognizing a constitutional right to same-sex marriage, ruling that states may not treat married same-sex couples differently from others in issuing birth certificates.
The decision was unsigned. Justice Neil M. Gorsuch, joined by Justices Clarence Thomas and Samuel A. Alito Jr., dissented.
The case concerns an Arkansas law about birth certificates that treats married opposite-sex couples differently from same-sex ones. A husband of a married woman is automatically listed as the father even if he is not the genetic parent. Same-sex spouses are not.
The case, Pavan v. Smith, No. 16-992, was brought by two married lesbian couples who had jointly planned their childs conception by means of an anonymous sperm donor. State officials listed the biological mother on the childrens birth certificates and refused to list their partners, saying they were not entitled to a husbands presumption of paternity.
The Arkansas Supreme Court ruled against the women, saying that it does not violate equal protection to acknowledge basic biological truths.

Ahhh, more penumbras.
Kennedy and Roberts.....tell me again how they are constitutionalist....
A “Constitutional right” to delusion
So we really only have 3 conservatives on the Supreme Court.
We need to retire 2 more to change the direction of the court.
Then require genetic testing at birth.
The good news here is Gorsuch voted the way Scalia would have. We NEED Kennedy to retire.
“Who is the father of the child?”
“No, the real father.”
“Does Susan have male sex organs?”
“Then who is the father?”
This nonsense comes to an end when reasonable and rational people decide to use this nonsensical crap to their strategic and financial benefit. For example, we see kids in high school that pretend to be a woman, then clean house in track and field.
Take a page out of the commie playbook and fight back!
Gays might not rejoice so much over this when they have to pay child support.
What kind of asinine stupidity is this? A child has a biological mother and a father. Period. Now there’s artificial insemination and donated eggs but the genetic source material is still distinctly male and female no matter how much the social justice morons wish it weren’t true.
If a state wants to legally restrict their certificates to the original donor material that’s within their legal right and Betty and Veronica can cry a river.
There are rumors about Kennedy and word is Ruth Bader has handed in her resignation months ago.
So when an analysis is done of a child’s genetic profile to determine whether he or she will have any hereditary diseases, are we going to do the analysis on the two gay fathers out of “equality”?
Whichever one the baby just came out of... That’s the mother.
I don’t care what they call the other one.
Makes me wonder what is the purpose of a birth certificate? Whose is it? The “Parents” or the baby? Is it a document to make the parents happy about the circumstances of the birth of a child, or is it for the future use of the child to document the reality of his “being”? I think we’ve got a mess happening here.
Good! Let them pay the child support when these phony arrangements go belly up!
More and more I believe that the birth certificate should be that and only that. Biological father, biological mother and maybe a footnote if you had a surrogate carry the baby. No more adoptions, step parents, multiplicity of family. Nope, just mother and father and if that cause embarrassment well just too bad.
First chance I had to read a Gorsuch dissent. His style of writing is every bit a good as Scalia’s was.
“Justice Neil M. Gorsuch, joined by Justices Clarence Thomas and Samuel A. Alito Jr., dissented.”
So Roberts and Kennedy side with the homosexualization of America once again.
Kennedy? No surprise.
