Special Prosecuter Rapes Trumps 4th Amendment Rights

There is no underlying crime that is being investigated!!

"4th Amendment – The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

Government is not permitted to dig into citizen’s past to find something that they can call a crime, nor are they permitted to expose personal information with the sole purpose of damaging a person’s reputation. But that is what Democrats are engaging in doing.

Manafort and the pre-dawn SWAT team raid on his home by the special counsel’s jack-booted FBI thug investigators for a white collar crime. . . uncalled for and unjustified exercise of Government overreach without an underlying crime.

Looks like they invented the information in the dossier just to use it as an excuse to start a special council so they could go on a fishing expedition to try and find something. If they find out the FBI paid for the dossier anyone involved should be prosecuted. These people have turned this country into a banana republic.

The President’s lawyers should file a federal case to shut down the Special Counsel’s office. Take it to the Supreme Court if needed!

Mueller’s appointment did not comply with law that says the Special Counsel appointment has to specify the crime being investigated. And Mueller is required to stick to that investigation. It is not like Ken Starr, who was operating under different law back then.

Mueller is operating unlawfully by not sticking to the “specific factual statement of the matter to be investigated” as mandated in CFR 600. Shut it down!

“Yeah! But Democrats can do whatever they want!”

Yes, but now it requires the complicity of the Congressional Republicans, which they have. Trey Dowdy said yesterday that he would not interfere with the Mueller investigation.

why go thru the hassle of attorneys ?
Pres. Trump can shut it down under his Constitutional authority.
Pres. Trump & his lawyers think this will be over earlier rather than later.
First of the year latest. If not, I am looking forward to a “Saturday Night Massacre”.

Optics

He can’t look like he is protecting a Republican President

The time to stop this investigation was before it started.

The Independent Council law is a bad law. It is a blank check to a prosecutor to investigate as long as he wants which will always be until he gets somebody.

The Independent Council law is a bad law. It is a blank check to a prosecutor to investigate as long as he wants which will always be until he gets somebody.

Which is why it was allowed to expire in 1999. Since then, the appointment of a Special Counsel is not part of federal law. Rather it's part of the "Code of Federal Regulations", which operates with force of law regarding government activities unless there's a superseding federal law.

For Mueller's appointment by Rosenstein, there's no superseding federal law, so such an appointment is now under CFR section 600, which was put in place by then Attorney General Janet Reno.

CFR Section 600 clearly states that the appointing (acting) Attorney General must specify the jurisdiction of a special prosecutor. It says, "The Special Counsel will be provided with a specific factual statement of the matter to be investigated". The whole point was to ensure the Special Counsel's jurisdiction did not run wild like Ken Starr's did, going from Whitewater land deal to Monica Lewinsky's blue dress.

The appointment of a Special Counsel must have strong limitations on what he is authorized to investigate and prosecute. It must state facts!

Rosenstein's appointment order did not state any facts. It loosely authorizes Mueller to investigate/prosecute "any links and/or coordination between the Russian government and individuals associated with the Trump campaign". There's nothing "factual" about that. No facts are provided!

Resenstein's order is unlawful and should be tossed out.

Still, the optics you raise cannot be dismissed. So, maybe it's not the White House legal team. Maybe it's Manafort's lawyers, or even Flynn's lawyers. Maybe Judicial Watch can do it. But someone needs to challenge in court Mueller's jurisdiction on the unlawful Rosenstein order, and take it to the Supreme Court if necessary.
