New Supreme Court Ruling A Boon To Trump’s Bid To Defend DACA Cancellation

A closely divided Supreme Court allowed President Donald Trump to shield documents relating to the cancellation of DACA, an Obama-era amnesty initiative that extended temporary legal status to foreign nationals who illegally entered the country as children.

The Court divided five to four along ideological lines in a late Friday ruling that temporarily permits the administration to conceal records relating to the program. Justice Stephen Breyer dissented from the decision, joined by Justices Ruth Bader Ginsburg, Sonia Sotomayor, and Elena Kagan.

The ruling is likely a boon to Trump’s efforts to defend DACA’s termination.

“The Department of Justice is pleased with the Supreme Court’s decision today putting on hold the district court’s overreach,” DOJ spokesman Devin O’Malley said. “The Department of Homeland Security acted within its lawful authority in deciding to wind down DACA in an orderly manner, and the Justice Department believes the courts will ultimately agree.”

DACA is not a law, it’s the action of a now departed executive branch.

Why would it be in the courts at all?

An obvious, clear ideological split on the Court. We need another President Trump appointment. Preferably, three more.

Obama pushed the edge of the envelope on Executive Branch power over immigration and illegal aliens and set a precedent of goat power and ruling by decree

There always seems to be more “court proceedings” required when the SOCTUS rules in favor of the administration but when a ruling on “marriage” happens it’s forever. Interesting.

I don’t get it either.

Bammy did an end run around congress cuz they didn’t vote his way. It’s not even Constitutional. The Constitution gives Congress, not the President, the power to make and to amend the laws.

The 4 that consented, have they even bothered to read the dang thing!! I vote no. Disgusting.

DACA should have been rescinded at 12:01PM on Jan 20th, 2017.

No basis or precedence in law whatsoever. Just another Obola decree.

Because the courts have been corrupted and politicized by the left. The ends justify the means...their oaths to uphold and defend the Constitution don’t mean sh!t.

DACA has been terminated the same way it was enacted. Pres. Trump via DHS rescinded it 9/5/17.
(IMO, DAPA was as big of a rollback) The problem now is, what to do with those who don't fall into the following:

If you already have DACA, your DACA and work permit will continue to be valid until its expiration date.
If you have a first-time or renewal DACA application that was accepted for processing by U.S. Citizenship and Immigration Services (USCIS) as of September 5, 2017,
the agency will continue with the process of adjudicating your application.
If you have a work permit (employment authorization document) that will expire between September 5, 2017, and March 5, 2018,
you may apply for a two-year renewal of your DACA, but your request must be accepted by USCIS by October 5, 2017.

Agree. Trump is all over the place on this issue.

Against DACA. But asks congress to send him a massive amnesty bill.

Campaigns on “Building a Wall”. But signs multiple spending bills that don’t fund it.

Meanwhile family-based immigration continues to pour the third world into our homeland at Obama/BushJunior rates.

Not me. California is part of the United States and should remain that way. I lived there for a few years and many people there are conservative and good Americans. If not for the big cities, it would be a red state. Also, the land and resources there are phenomenal. No way should we be giving that up.
