Virginia court tosses out one-vote victory that briefly ended GOP majority in House

A three- judge panel declined to certify the recount of a key House race today, saying that a questionable ballot should be counted in favor of the Republican and tying a race that Democrats had thought they had won by a single vote.

“The court declares there is no winner in this election,” said Circuit Court Judge Bryant L. Sugg, after the judges deliberated for more than two hours.

The court’s decision leaves the race for the 94th District tied at 11,608 votes for each Del. David Yancey, the Republican incumbent, and Shelly Simonds, his Democratic challenger.

And it leaves the balance of power in the state legislature at 49-51, in favor of Republicans - at least for now.

In the case of a tie in a House race, state law says the winner is chosen by lot – essentially, a coin toss, according to Virginia state law.

Odd decision, not good that an valid election can be overthrown if the judge does not like the result.

If there was no fraud, 1 vote majority is a victory.

If there is fraud, prove it and reject those votes = A many-vote victory for the honest voters.

The vote was a questionable one and that is why it was tossed out.

The ballot was a vote for both candidates but they struck out the vote for the Democrat

I think the question involves a vote that was contested.

Nevada had a local election about 25 years ago that ended in a dead heat. With no provision for breaking a tie, the two candidates agreed to play a single hand of poker to determine the winner. LMAO.

I love it! The Republican will draw the lot just so as to make Democrat worshiping media turn purple.

Democrats will just have to wait to raise taxes, register to vote more illegals and felons, and corrupt Virginian youth with gender-bender permits.

An election on a coin toss throws out every ones vote. Everyone is therefore disenfranchised. Unconstitutional!!

You have to rerun the race with only the same voters voting.

Any outstanding military ballots?

From what I have read, it was a 10 vote victory for the Republican, and after a recount, turned into a 1 vote victory for the Democrat.

It's been a while since I delved into statistics, but to get a turnaround like that on a recount, even for 10 votes, is unlikely. The initial winner is more than likely to pick up votes.

Thus I suspect fraud.
