Trump ICE pick: Politicians who run sanctuary cities should be charged with crimes

President Trump's pick to run Immigration and Customs Enforcement (ICE) on Tuesday called for a crackdown on so-called sanctuary cities, saying politicians who help run them should be charged with crimes.

In an interview with Fox News' Neil Cavuto, ICE Acting Director Thomas Homan said the Department of Justice needs "to file charges against the sanctuary cities" and "hold back their funding."

Homan, who was announced in December as President Trump's pick to permanently run the agency, went on to say that politicians enforcing sanctuary city policies need to be held "personally accountable."

"We gotta take [sanctuary cities] to court, and we gotta start charging some of these politicians with crimes," he said.

His comments came during a discussion about California Gov. Jerry Brown (D), a staunch defender of protections for undocumented immigrants who in October signed a bill declaring California a sanctuary state.

Sanctuary cities, which limit their cooperation with federal law enforcement in an effort to shield undocumented migrants from deportation, have increasingly come under fire since President Trump took office in January.

Attorney General Jeff Sessions has repeatedly called for tougher measures for sanctuary cities, including the withholding of federal grants for them.

Trump made the issue central to his campaign in 2016, arguing that sanctuary city policies prevent law enforcement from keeping Americans safe.

Can we make nominations?

I don’t want our superlative governor Jerry Brown to miss out on something owed to him.

Even though he’s a Democrat, it just wouldn’t be fair.

Heard today that 27 out of the last 50 years, CA has been run by a Brown family member. Is that possibly true?

Arrest the mayors in all sanctuary cities and arrest Governor Brown in California. They are engaging in a non-violent rebellion. They need a lesson in the Supremacy Clause.

“Homan said that Brown and other sanctuary-jurisdiction leaders may have violated 8 U.S. Code § 1324 - relating to “harboring certain aliens.”

He said he hopes the Justice Department will look into whether officials can be criminally charged under the statute.

According to text of the federal law cited by Homan, any person “knowing... the fact that an alien has come to... the United States in violation of the law, conceals, harbors or shields from detection... such [an] alien in any place” can face fines and/or up to several years in prison.

Well I have been asking about this for ever. Never could get an answer. Not even here. About time.

Note that the law says the penalty applies for each occurrence. So you can count each illegal being shielded and multiply the penalty by that number.

Here is the Law:

(ii) in the case of a violation of subparagraph (A)(ii), (iii), (iv), or (v)(II), be fined under title 18, imprisoned not more than 5 years, or both;

(iii) in the case of a violation of subparagraph (A)(i), (ii), (iii), (iv), or (v) during and in relation to which the person causes serious bodily injury (as defined in section 1365 of title 18) to, or places in jeopardy the life of, any person, be fined under title 18, imprisoned not more than 20 years, or both; and

(iv) in the case of a violation of subparagraph (A)(i), (ii), (iii), (iv), or (v) resulting in the death of any person, be punished by death or imprisoned for any term of years or for life, fined under title 18, or both.

I’ve posted the law many times as well. Criminals like Brown are breaking the law.
Enforce the law, Rip van Sessions! They aren’t exempt, unless the DC overlords are providing some kind of professional scofflaw courtesy ...
Put the `sanctuary’ lawbreakers on notice that they are in violation. They would do it to us in a heartbeat if we broke their federal or state laws.
If they ignore the notice, start indicting them. Like a lot of law-abiding citizens, I’m fed up with their nose-in-the-air “We’re above the law” bullshit.
